Insists that any reduction in the amount of legislation must be off-set by more emphasis on implementation; stresses that complaints are a cost-effective and efficient tool for monitoring the application of Community law and calls on the Commission to make sure that at least some of the resources previously allocated to the drafting and follow-up of legislation are dedicated to the effective and correct implementation of existing Community legislation in the various units dealing with individual complaints and infringement cases;

The Committee considers that, if a Community patent is to operate effectively and efficiently, a Community-wide form of legal jurisdiction should be established and would support the establishment of a Community Intellectual Property Court on the lines proposed by the Commission with the proviso that the functions of First Instance are carried out in existing national tribunals operating in the capacity of a Community Court of First Instance (in the country where the defendant is domiciled or where the breach has taken place).
Het ESC is van mening dat het Gemeenschapsoctrooi uitsluitend een efficiënt middel is wanneer er een gerecht wordt opgericht dat voor de gehele EG bevoegd is. Het steunt daarom het voorstel om een Gemeenschappelijk Gerecht voor intellectuele eigendom in het leven te roepen. Voorts vindt het dat de functie van rechter in eerste aanleg ook moet kunnen worden uitgeoefend door nationale gespecialiseerde rechterlijke instanties, die dan in de lidstaat waar verweerder is gevestigd of waar de inbreuk heeft plaatsgevonden als communautaire rechter optreden.
