For the purposes of Article 42(1a)(a), the Member States shall draw up and publish a list of the commercial designations accepted on their territory.
Voor de toepassing van artikel 42, lid 1 bis, onder a), en lid 2, onder a), stellen de lidstaten de lijst vast van de handelsbenamingen die op hun grondgebied zijn toegestaan, en maken zij deze bekend.

9. Stresses the importance of labelling and of accurate consumer information, with a view to boosting the quality and value added of fisheries products; believes that commercial designations, notably for imported products, need to be examined and checked with all care to ensure that consumers are not misled;

Nevertheless, in the view of the Commercial Court, the designation ‘Bud’ must rather be classified as a designation of origin covering goods whose specific features can be attributed to natural or human factors inherent in their place of provenance.
Volgens de handelsrechtbank moet de benaming „Bud” echter eerder als een oorsprongsbenaming worden gekwalificeerd, die producten aanduidt waarvan de bijzonderheden zijn toe te schrijven aan factoren van natuurlijke of menselijke aard van hun plaats van herkomst.

If the Commercial Court were to classify the designation ‘Bud’ as a simple indication of geographical provenance, it would have to ascertain whether, according to factual circumstances and perceptions prevailing in the Czech Republic, the designation ‘Bud’ is at least capable of informing the consumer that the product bearing that indication comes from a particular place or region of that Member State and has not become generic in that Member State.

In order to ascertain whether Community law authorises the protection conferred by the bilateral agreement on the designation ‘Bud’, the Commercial Court seeks clarification on the basis of two divergent premises regarding the classification of the designation ‘Bud’.
Om te vernemen of de bescherming die op grond van het bilaterale verdrag aan de benaming „Bud” wordt verleend, uit gemeenschapsrechtelijk oogpunt aanvaardbaar is, verzoekt de handelsrechtbank om verduidelijking op basis van twee uiteenlopende premissen betreffende de kwalificatie van de benaming „Bud”.

The Commercial Court of Vienna (Austria) asks the Court of Justice to clarify on what conditions the designation ‘Bud’ may be protected, under a bilateral agreement, for beer produced in the Czech Republic.

3. Without prejudice to the unique, Community nature of the content of the documents referred to in Article 9(4)(a), (b), (c) and (d) and in Article 34(4)(a) to (e), this Regulation shall not prohibit the use of two or more commercial designs for a given medicinal product covered by a single authorisation.

Onverminderd het enkelvoudige en communautaire karakter van de inhoud van de in artikel 9, lid 4, onder a), tot en met d), en artikel 31, lid 4, onder a) tot en met e), bedoelde documenten vormt deze verordening geen beletsel voor het gebruik van verscheidene commerciële modellen ("design") voor eenzelfde geneesmiddel waarvoor eenzelfde vergunning is verleend.

2. Without prejudice to the unique, Community nature of the content of the documents referred to in points (a) to (d) of Article 10 (4) and in points (a) to (e) of Article 39 (4), this Regulation shall not prohibit the use of two or more commercial designs for a given medicinal product covered by a single authorisation.

Onverminderd het unieke en communautaire karakter van de inhoud van de in artikel 10 , lid 4, onder (a) tot en met d) , en artikel 39 , lid 4, onder a) tot en met e ), bedoelde documenten verbiedt deze verordening niet het gebruik van diverse commerciële modellen ("design") voor eenzelfde geneesmiddel waarvoor eenzelfde vergunning is verleend.

It is design which is decisive, in many cases, for the commercial success of products, thus allowing all those European enterprises who invest heavily in development of designs to prosper.
Vaak hangt het van de vorm en het uitzicht van een produkt af of het bij het publiek aanslaat, en het commerciële succes van hun produkten is bepalend voor de bloei van Europese bedrijven die zwaar in design investeren.
