A private prosecution has been brought against Mr Hans-Peter Martin in the Vienna Regional Criminal Court on 6 June 2007 by Merkur Treuhand Wirtschaftstreuhand- und Steuerberatungs Gesellschaft mit beschränkter Haftung for commercial defamation pursuant to Section 152 of the Austrian Criminal Code on the ground that, both on his website www.hpmartin.net and in APA-OTS press release OTS0189 5 11 0473 NEF0006 in connection with the accusations against him (by the EU anti-fraud authority OLAF) of improper use of the secretarial assistance allowance for staff, he had claimed that it had been established after a comprehensive, detailed investigation that he had in no way improperly used EU monies and that fault had been found only with a formal error on the part of his accounts manager at the time, Mr Christoph Matznetter, a tax adviser now State Secretary for Finance in the Austrian Government, who, according to Mr Martin, had incorrectly charged three staff computers and two telephone bills to the secretarial assistance allowance instead of to the office expenses allowance.

By way of derogation from the second subparagraph of Chapter III(A)(a) of Section III of Annex I to Regulation (EC) No 854/2004, establishments wishing to use their staff assisting with official controls shall, during the transitional period, be exempted from the requirement to possess an internationally recognised certification, provided that the establishment demonstrates that it has initiated and is pursuing certification in accordance with international standards, such as relevant EN ISO standards on quality management or food safety.

2a. By way of derogation from Article 1, Title IV Chapters 1-2 and 6 - 6 b shall apply to parliamentary assistants employed by Members of the European Parliament. Such staff shall be paid from the appropriations for this purpose under the section of the budget for the European Parliament. The European Parliament shall adopt implementing rules.
2 bis. In afwijking van artikel 1 is Titel IV Hoofdstukken 1-2 en 6-6 ter van toepassing op parlementaire medewerkers in dienst van leden van het Europees Parlement. For all systems handling information classified EU CONFIDENTIAL and above, a System-specific security requirement statement (SSRS) shall be required to be produced by its Technical System Owner (TSO, see Section 25.3.4) and the Information Owner (see Section 25.3.5) in cooperation with input and assistance as required from the project staff and from the Commission Security Office (as INFOSEC Authority -IA, see Section 25.3.3) and approved by the Security Accreditation Authority (SAA, see Section 25.3.2).

Article 1303 (7) of the social insurance code (RVO) and Article 82 (7) of the clerical staff insurance law (AVG) shall apply only in respect of periods for which compulsory contributions under German pension insurance were paid in addition to contributions to the Greek special scheme for civil servants and in respect of periods equivalent to periods of insurance immediately following periods in which such compulsory contributions had been paid' (c) In Section E.
