Noting that the 61st session of the CHR and the 60th session of UNGA Third Committee took place against the backdrop of UN reform, the Council welcomes the progress made in a number of EU priority areas, including the adoption at CHR and UNGA Third Committee of all, except one, of the EU's texts on country situations, and all of the EU's texts on thematic issues.

Supports the replacement of the Commission on Human Rights with a reduced standing Council on Human Rights directly elected by the General Assembly – which, when electing members to serve in that body, should choose countries that respect human rights most scrupulously – with a strengthened majority, which will give it greater democratic legitimacy and political authority; supports the incorporation into the working methods of the UNCHR of a ‘peer review’ mechanism which would allow for each country to be subject, on a regular basis, to a human rights assessment; supports the idea of linking accession to the CHR to the obligation for a member state to issue a standing invitation to the UN mechanisms and procedures; considers that it is of utmost importance to reinforce the role of independent NGOs within the CHR and that their participation requires a reform of the Committee of NGOs;

It underlined the importance of the special mechanisms developed in the CHR framework over the years, and expressed the wish that all States which are members of the United Nations should cooperate fully with the special rapporteurs, special representatives, independent experts and CHR working parties.

4. In this connection, the Council restated its conviction that the CHR should retain the possibility of examining the human rights situation in particular countries, this being an essential part of the CHR's mandate.

The fact that the EU lost the vote on its draft resolution on the human rights situation in Iran at the UN Commission on Human Rights (CHR) in spring this year did have the effect that the mandate of the UN Special Representative for that country came to an end. However, it should be noted that the Iranian Government had in any event never extended an invitation to the UN Special Representative to visit (this was one of the matters on which the EU had intended to express concern through its draft resolution).

The Council confirmed its position concerning the EU's approach to China in the CHR where it will express its growing concerns on the human rights situation in China.
