The necessary arrangements concerning the accommodation to be provided for CEPOL in Hungary and the facilities to be made available by that Member State together with the specific rules applicable in the host Member State to the Executive Director, members of the Management Board, CEPOL staff and members of their families, shall be laid down in a Headquarters Agreement between CEPOL and Hungary concluded after obtaining the approval of the Management Board.

Further to a report on its first three years of operation ,in its conclusions of February 2005, the Council called for improvements in the functioning of the (CEPOL): it was considered that CEPOL could operate more effectively if it were financed from the general budget and if the Staff Regulations of officials of the European Communities and the Conditions of employment of other servants of the European Communities applied to the staff of CEPOL.
Naar aanleiding van een verslag over de eerste drie jaar waarin de EPA operationeel was, riep de Raad, in zijn conclusies van februari 2005, ertoe op de werking van de EPA te verbeteren: men was van mening dat de EPA beter zou kunnen functioneren als zij uit de algemene begroting van de Europese Unie zou worden gefinancierd en haar personeel onder het statuut van de ambtenaren en andere personeelsleden van de Europese Gemeenschappen zou vallen.

We decided to vote against the Decision on Cepol as amended foreseeing to move Cepol from Bramshill (UK) to Budapest (HU) as we believe that this creates a dangerous institutional precedent in the EU in relation to the location of bodies and agencies: while the Commission proposed to merge Cepol with Europol in The Hague, the Council decided to accommodate the unilateral decision of a Member State not to host such body anymore in the foreseen location or within the same Member State; it discussed during an informal lunch different location candidatures, denying to the EP the right to examine the accompanying budgetary impact assessments; the co-location of Cepol and Europol reasonably appears to be the best option to ensure that costs are minimized and synergies improved; it is unclear who will pay for the relocation, while Cepol and its staff members are subjected to uncertainty; the Council is discussing a further review of the Cepol Decision, as illustrated in Council document 6476/14, which leads us to the conclusion that it would have been better to call the Council to provide the EP with a detailed impact assessments and wait for the Cepol decision to be reviewed in its entirety.
Wij hebben besloten tegen het gewijzigde besluit inzake Cepol te stemmen, dat de verhuizing beoogt van Cepol van Bramshill (VK) naar Boedapest (Hongarije), omdat wij van mening zijn dat dit een gevaarlijk institutioneel precedent binnen de EU schept met betrekking tot de huisvesting van organen en agentschappen: terwijl de Commissie het voorstel doet om Cepol met Europol in Den Haag samen te voegen, heeft de Raad besloten het eenzijdige besluit van een lidstaat te billijken om een dergelijke instantie niet meer op de aangewezen locatie of binnen dezelfde lidstaat te huisvesten; de Raad heeft tijdens een informele lunch verschillende kandidaatstellingen voor een andere locatie besproken en bijgevolg het EP het recht onthouden om de bijgaande budgettaire effectbeoordelingen te onderzoeken; de gezamenlijke huisvesting van Cepol en Europol lijkt redelijkerwijs de beste oplossing om er voor te zorgen dat de kosten zo laag mogelijk worden gehouden en de synergieën worden vergroot; het is onduidelijk wie de zetelverplaatsing zal betalen terwijl Cepol en zijn personeel in een onzekere situatie verkeren; de Raad bespreekt thans een nadere herziening van het Cepol-besluit, zoals te lezen is in Raadsdocument 6476/14, wat voor ons reden is te concluderen dat het beter zou zijn geweest om de Raad te verzoeken het EP een uitgebreide effectbeoordeling te verstrekken en de algehele herziening van het Cepol-besluit af te wachten.

The Commission shall, not later than 18 months after the entry into force of this Regulation, evaluate the effectiveness of Decision 2005/681/JHA in the light of the provisions of the Treaty on the Functioning of the European Union governing CEPOL, as well as the new tasks envisaged for CEPOL in the Commission Communication of 27 March 2013 entitled 'Establishing a European Law Enforcement Training Scheme' and if appropriate issue legislative proposals to amend Decision 2005/681/JHA, while at the same time ensuring CEPOL's complete independence.
Uiterlijk 18 maanden na de inwerkingtreding van deze Verordening voert de Commissie een evaluatie uit van de doeltreffendheid van Verordening 2005/681/JBZ in het licht van de bepalingen van het Verdrag betreffende de werking van de Europese Unie die op Cepol betrekking hebben, alsook van de nieuwe taken van Cepol zoals die zijn opgenomen in de mededeling van de Commissie van 27 maart 2013 tot vaststelling van een Europees opleidingsprogramma voor rechtshandhaving, en dient zo nodig wetgevingsvoorstellen in tot wijziging van Verordening 2005/681/JBZ, waarbij tegelijkertijd de volledige onafhankelijkheid van Cepol gewaarborgd wordt.

3. Calls on the budgetary authorities to ensure that the additional costs relating to the change in the seat of CEPOL will be fully covered by the current host country and by additional Union budget and thus will not adversely affect the regular budget of CEPOL so as not to jeopardise the normal operational needs of CEPOL.

Takes note that CEPOL’s budget amounted EUR 8 341 000 for the financial year 2011 and that CEPOL is entirely financed by the Union's budget; notes further that in 2011, CEPOL committed 96,74% of the appropriations received which represents a slight decrease compared to 2010 (99,56%); observes however a substantial increase from 59,12% to 75,21% in terms of paid commitment between 2010 and 2011; acknowledges CEPOL’s efforts to improve the budgeting and commitment process;
2. constateert dat de begroting van CEPOL voor het begrotingsjaar 2011 EUR 8 341 000 bedroeg, en dat CEPOL volledig door de begroting van de Unie wordt gefinancierd; stelt verder vast dat CEPOL in 2011 96,74% van de ontvangen kredieten heeft vastgelegd, een percentage dat in vergelijking met 2010 (99,56%) neerkomt op een geringe daling; constateert echter een significante toename van 59,12% tot 75,21% in termen van betaalde vastleggingen tussen 2010 en 2011; erkent de inspanningen van CEPOL om het begrotings- en vastleggingsproces te verbeteren;

2. CEPOL shall accede to the Inter-institutional Agreement of 25 May 1999 concerning internal investigations by the European Anti-fraud Office (OLAF) and shall issue, without delay, the appropriate provisions applicable to the Director of CEPOL and the staff of CEPOL’s Secretariat.

De EPA treedt toe tot het interinstitutioneel akkoord van 25 mei 1999 betreffende de interne onderzoeken verricht door het Europees Bureau voor fraudebestrijding (OLAF) en stelt onverwijld de desbetreffende voorschriften vast die op de directeur van de EPA en het personeel van het secretariaat van de EPA van toepassing zijn.
