Urges the Commission therefore to include the applicant countries' national action plans in the EU's ongoing evaluation of biological diversity; also urges the Commission to make aid to those countries dependent on biological diversity criteria and not to grant derogations from the Community's nature conservation legislation;

(56) Overwegende dat tijdens de derde conferentie van de partijen bij het Verdrag inzake de biologische diversiteit, welke in november 1996 plaatsvond, in Besluit III/17 is vastgesteld dat nog verder moet worden gewerkt aan een gemeenschappelijke evaluatie van de relatie tussen de intellectuele-eigendomsrechten en de desbetreffende bepalingen van de TRIP's-overeenkomst en het Verdrag inzake biologische diversiteit, met name voor kwesties in verband met de overdracht van technologie en het behoud en duurzame gebruik van de biologische diversiteit, alsmede de rechtvaardige en billijke verdeling van voordelen die voortvloeien uit het gebruik van genetische hulpbronnen, met inbegrip van de bescherming van de kennis, innovaties en gewoonten van inheemse en plaatselijke gemeenschappen die een traditionele manier van leven erop nahouden die van belang is voor het behoud en het duurzame gebruik van de biologische diversiteit,

Whereas, with a view to the preservation of biological and genetic diversity in agriculture in the Community, which constitutes an irreplaceable fund of biological and genetic resources, genetic resources should be preserved; whereas all necessary measures should be taken to conserve, characterize, collect and utilize those resources to promote the aims of the common agricultural policy and safeguard biological diversity in line with the Convention on Biological Diversity ratified by the Community in 1993; whereas all forward-looking solutions which might prove necessary should be applied;
