Whereas, as far as the activities of employed persons in the field of architecture are concerned, Council Regulation (EEC) No 1612/68 of 15 October 1968 on freedom of movement for workers within the Community (1) lays down no specific provisions relating to good character or good repute, professional discipline or use of title for the professions covered; whereas, depending on the individual Member State, such rules are or may be applicable both to employed and to self-employed persons; whereas activities in the field of architecture are subject in several Member States to possession of a diploma, certificate or other evidence of formal qualifications; whereas such activities are pursued by both employed and self-employed persons, or by the same persons in both capacities in the course of their professional career; whereas, in order to encourage fully the free movement of members of the profession within the Community, it therefore appears necessary to extend this Directive to employed persons in the field of architecture;
Overwegende dat, ten aanzien van de werkzaamheden in loondienst op het gebied van de architectuur, Verordening (EEG) nr. 1612/68 van de Raad van 15 oktober 1968 betreffende het vrije verkeer van werknemers binnen de Gemeenschap (1) geen specifieke bepalingen over goed gedrag en betrouwbaarheid, beroepsdiscipline en het voeren van een titel voor de gereglementeerde beroepen bevat; dat de desbetreffende regelingen naar gelang van de Lid-Staten zowel op werknemers als op zelfstandigen worden of kunnen worden toegepast; dat de werkzaamheden op het gebied van de architectuur in verscheidene Lid-Staten afhankelijk zijn gesteld van het bezit van een diploma, certificaat of andere titel; dat deze werkzaamheden zowel door zelfstandigen als door werknemers of ook afwisselend als werknemer en als zelfstandige door dezelfde personen gedurende hun loopbaan worden uitgeoefend; dat het, voor een werkelijke bevordering van het vrije verkeer van deze beroepsbeoefenaars binnen de Gemeenschap, derhalve noodzakelijk lijkt het toepassingsgebied van deze richtlijn uit te breiden tot werknemers die werkzaam zijn op het gebied van de architectuur;
