‘manufacturer’ means any natural or legal person who is responsible to the approval authority for all aspects of the engine EU type-approval or authorisation process and for ensuring conformity of engine production, and who is also responsible for market surveillance concerns for the engines produced, whether or not they are directly involved in all stages of the design and construction of the engine which is the subject of the EU type-approval process.

4. Where, in the course of monitoring conformity of production following the issue of an EU type-approval certificate, a technical service acting on behalf of the designating approval authority finds that an engine type or engine family no longer complies with this Regulation, it shall report that fact to the designating approval authority.

3.2. The approval authority shall take into consideration data from the manufacturer that details such factors as, but not limited to, technical feasibility, lead time and production cycles including phase-in or phase-out of engines or vehicle designs and programmed upgrades of computers, the extent to which the resultant OBD system will be effective in complying with the requirements of this Regulation and that the manufacturer has demonstrated an acceptable level of effort toward compliance with the requirements of this Regulation.
3.2. 13. ‘manufacturer’ means any natural or legal person who manufactures a product or has such a product designed or manufactured and markets that product under his name or trademark; this shall include any natural or legal person who adapts engines for marine use where the source engine is already type-approved in accordance with Directive 97/68/EC or Directive 2005/55/EC without altering the exhaust emissions characteristics of the engine;

It offends against the fundamental requirement for reasons under Article 253 of the Treaty in that there is no explanation at all in the regulation for the use of the bypass ratio of an aircraft engine as a criteria when internationally approved noise and emissions standards certification for aircraft engines already exist. It is contrary to the principle of proportionality and, most importantly, it is contrary to the rules of the WTO which require the use of performance standards, not design standards, as is the case in this regulation.
Ze is ook in strijd met het in artikel 253 van het Verdrag neergelegde beginsel dat verordeningen met redenen omkleed dienen te worden. In de verordening wordt namelijk niet uitgelegd waarom de omloopleidingverhouding van een vliegtuigmotor als criterium wordt gebruikt, terwijl er al een internationaal erkende geluids- en emissienormencertificering voor vliegtuigmotoren bestaat. Bovendien is er sprake van een schending van het proportionaliteitsbeginsel en met name van de regels van de WTO, waarin het gebruik van prestatienormen verplicht wordt gesteld en niet het gebruik van ontwerpnormen zoals in de verordening het geval is.
