Where quantities that exceed those determined in accordance with paragraph 1(a) are applied for, the Commission may adopt implementing acts, without applying the procedure referred to in Article 44(2) or (3), limiting the quantities in respect of which inward processing certificates may be issued, rejecting quantities applied for in respect of inward processing certificates and suspending the lodging of applications for inward processing certificates for the product concerned.

(47) In order to ensure uniform conditions for the implementation of this Regulation as regards exports, implementing powers should be conferred on the Commission in respect of measures on the application of refund rates, on the calculation of the export refunds, on the assimilation of certain products to basic products and the determination of the reference quantity of basic products, on the application for, the issuing of and the management of certificates for the export of certain non-Annex I goods to certain destinations when provided for in an international agreement concluded or provisionally applied by the Union in accordance with the TFEU and on the treatment of disappearances of products and quantity losses during the manufacturing process and the treatment of by-products.

The Commission, on its own initiative or at the request of a Member State, after consulting the committee for the relevant agriculture or fisheries common market organisation, shall decide, in accordance with the examination procedure referred to in Article 38(3), whether to apply this special surveillance mechanism, and shall determine the products to which this surveillance mechanism is to be applied.

6. Provisional safeguard measures may be adopted by the Commission by means of implementing acts in critical circumstances where a delay would cause damage which would be difficult to repair, pursuant to a preliminary determination on the basis of the factors laid down in paragraph 4 which establishes that there is sufficient evidence that imports of a product covered by this Regulation have increased as the result of the suspension of customs duties under this Regulation, and such imports cause serious difficulties, or threat thereof, to the Union industry. Those implementing acts shall be adopted in accordance with the advisory procedure referred to in Article 8(1a).Provisional measures shall not apply for more than 200 days.
6. In kritieke omstandigheden kunnen door de Commissie middels uitvoeringsbesluiten voorlopige vrijwaringsmaatregelen worden genomen wanneer vertraging moeilijk te herstellen schade zou veroorzaken, nadat voorlopig is vastgesteld, op grond van de in artikel 4 vermelde factoren, dat er voldoende aanwijzingen zijn voor een toename van de invoer van onder deze verordening vallende goederen als gevolg van de opschorting van douanerechten ingevolge deze verordening, en dat dergelijke invoer ernstige schade veroorzaakt of dreigt te veroorzaken voor de bedrijfstak van de EU. Deze uitvoeringsbesluiten worden vastgesteld overeenkomstig de in artikel 8, lid 1 bis, bedoelde raadplegingsprocedure. Voorlopige maatregelen gelden voor ten hoogste 200 dagen.

7. By way of derogation from paragraph 2, Member States shall determine the product-related historical activity level for products to which the product benchmarks referred to in Annex III apply on the basis of the median annual historical production according to the formulas set out in this same Annex.
7. In afwijking van lid 2 bepalen de lidstaten het productgerelateerde historische activiteitsniveau voor producten waarop de in bijlage III opgenomen productbenchmarks van toepassing zijn, op basis van de mediane jaarproductie in overeenstemming met de in die bijlage weergegeven formules.
