The 2012 commitments included the following measures with respect to ÖVAG, to limit distortions of competition: (i) reduction of balance sheet and RWAs; (ii) restriction of activities to the ‘association-related business’ of ÖVAG, as the Verbund's central organisation; (iii) a ban on acquisitions; (iv) a ban on price leadership, applicable to ÖVAG's online banking subsidiary, Live Bank; (v) a ban on referring to State aid for advertising purposes; and (vi) behavioural measures relating to remuneration and risk management systems.

(11) Whereas the use of means of distance communication must not lead to a reduction in the information provided to the consumer; whereas the information that is required to be sent to the consumer should therefore be determined, whatever the means of communication used; whereas the information supplied must also comply with the other relevant Community rules, in particular those in Council Directive 84/450/EEC of 10 September 1984 relating to the approximation of the laws, regulations and administrative provisions of the Member States concerning misleading advertising (7); whereas, if exceptions are made to the obligation to provide information, it is up to the consumer, on a discretionary basis, to request certain basic information such as the identity of the supplier, the main characteristics of the goods or services and their price;
(11) Overwegende dat het gebruik van technieken voor communicatie op afstand niet tot een vermindering van de aan de consument verstrekte informatie mag leiden; dat het derhalve wenselijk is te bepalen welke informatie, ongeacht de gebruikte communicatietechniek, verplicht aan de consument moet worden verstrekt; dat de verstrekte informatie bovendien aan de overige relevante communautaire regelgeving moet beantwoorden, met name aan Richtlijn 84/450/EEG van de Raad van 10 september 1984 betreffende het nader tot elkaar brengen van de wettelijke en bestuursrechtelijke bepalingen der lidstaten inzake misleidende reclame (7); dat, indien er uitzonderingen worden gemaakt op de informatieplicht, de consument op discretionaire basis zal moeten verzoeken om een zekere basisinformatie, zoals de identiteit van de leverancier, de hoofdkenmerken van de goederen of diensten en de prijs;
