Whereas under Regulation (EEC) No 1820/87 of 25 June 1987 concerning the application of Decision No 2/87 of the ACP-EEC Council of Ministers on the advance implementation of the Protocol to the third ACP-EEC Convention consequent on the Accession of the Kingdom of Spain and the Portuguese Republic to the European Community (3), Spain and Portugal may postpone implementation of the preferential arrangements for fruit and vegetables covered by Regulation (EEC) No 1035/72 (4), as last amended by Regulation (EEC) No 1119/89 (5), until 31 December 1989 and 31 December 1990 respectively; whereas, consequently, the abovemntioned tariff concession is not currently applicable in Spain or Portugal, but from 1 January 1990 it will apply throughout the Community except in Portugal; whereas from this date and within the limits of its tariff quotas Spain must apply customs duties calculated in accordance with the abovementioned protocol to the third ACP-EEC Convention;
Overwegende dat krachtens Verordening (EEG) nr. 1820/87 van de Raad van 25 juni 1987 betreffende de toepassing van Besluit nr. 2/87 van de ACS-EEG-Raad van Ministers inzake vervroegde toepassing van het Protocol bij de Derde ACS-EEG-Overeenkomst in verband met de toetreding van het Koninkrijk Spanje en de Portugese Republiek tot de Europese Gemeenschappen (3), in Spanje en Portugal de toepassing van de preferentiële regeling in de sector groenten en fruit vallende onder Verordening (EEG) nr. 1035/72 van de Raad (4), laatstelijk gewijzigd bij Verordening (EEG) nr. 1119/89 (5), wordt uitgesteld tot respectievelijk 31 december 1989 en 31 december 1990; dat derhalve het bovengenoemde tariefvoordeel niet van toepassing is in Spanje en in Portugal, terwijl dit met ingang van 1 januari 1990 van toepassing is in de Gemeenschap met uitzondering van Portugal; dat Spanje met ingang van dit tijdstip en binnen de begrenzing van deze tariefcontingenten douanerechten dient toe te passen die berekend zijn overeenkomstig de bepalingen van het bovengenoemde Protocol bij de Derde ACS-EEG-Overeenkomst;
