(9) This Regulation constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.
(9) Deze verordening vormt overeenkomstig het Protocol tot opneming van het Schengenacquis in het kader van de Europese Unie een ontwikkeling van het Schengenacquis als omschreven in bijlage A bij Besluit 1999/435/EG van de Raad van 20 mei 1999 tot vaststelling in overeenstemming met de desbetreffende bepalingen van het Verdrag tot oprichting van de Europese Gemeenschap en het Verdrag betreffende de Europese Unie, van de rechtsgrondslag van elk van de bepalingen of besluiten die het Schengenacquis vormen.

This Regulation constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC[13] of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

(12) This instrument constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

An essential part of the observance of the application of the rules of the Schengen acquis, which form part of European law, is the evaluation mechanism, which should guarantee the transparent, efficient and consistent implementation of the Schengen acquis, and also reflect the changes to the legislative situation which came into being after the integration of the Schengen acquis into the EU framework.
Een essentieel onderdeel van het nakomen van de toepassing van de regels van het Schengenacquis, die onder de Europese wetgeving vallen, is het evaluatiemechanisme, dat bedoeld is om de transparante, efficiënte en consequente tenuitvoerlegging van het Schengenacquis te waarborgen, en tevens de wijzigingen in de wetgevingssituatie die na de integratie van het Schengenacquis in het kader van de EU zijn ontstaan te weerspiegelen.

As regards Liechtenstein, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis which fall within the area referred to in Article 1, point B of Decision 1999/437/EC read in conjunction with Article 3 of Council Decision 2008/261/EC of 28 February 2008 on the signature, on behalf of the European Community, and on the provisional application of certain provisions of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (7).

As regards Iceland and Norway, this Decision constitutes a development of provisions of the Schengen acquis within the meaning of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the latters association with the implementation, application and development of the Schengen acquis (4), which fall within the area referred to in Article 1, point B of Council Decision 1999/437/EC of 17 May 1999 (5) on certain arrangements for the application of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the association of those two States with the implementation, application and development of the Schengen acquis.
Wat IJsland en Noorwegen betreft, vormt deze beschikking een ontwikkeling van bepalingen van het Schengenacquis, in de zin van de Overeenkomst tussen de Raad van de Europese Unie, de Republiek IJsland en het Koninkrijk Noorwegen inzake de wijze waarop IJsland en Noorwegen worden betrokken bij de uitvoering, de toepassing en de ontwikkeling van het Schengenacquis (4), die betrekking hebben op het gebied bedoeld in artikel 1, onder B, van Besluit 1999/437/EG van de Raad (5) inzake bepaalde toepassingsbepalingen van die overeenkomst.

C. whereas, according to Article 3(2) of the 2003 Act of Accession , the provisions of the Schengen acquis other than those mentioned in Annex I to that Act only apply in a new Member State within the meaning of that Act pursuant to a Council Decision to that effect after verification that the necessary conditions for the application of that acquis have been met,

In accordance with the second subparagraph of Article 3(2) of the 2003 Act of Accession and as a result of the partial application of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland provided for in Council Decision 2004/926/EC of 22 December 2004 on the putting into effect of parts of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland (5), and in particular the first subparagraph of Article 1 thereof, only part of the provisions of the Schengen acquis applicable to the Member States concerned in their relations with Member States applying the Schengen acquis in full should apply in the relations of the Member States concerned with the United Kingdom of Great Britain and Northern Ireland.
Overeenkomstig artikel 3, lid 2, tweede alinea, van de Toetredingsakte van 2003 en als gevolg van de gedeeltelijke toepassing van het Schengenacquis door het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland overeenkomstig Besluit 2004/926/EG van de Raad van 22 december 2004 betreffende de toepassing door het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland van delen van het Schengenacquis (2004/926/EG) (5), inzonderheid artikel 1, eerste alinea, dient in de betrekkingen van de betrokken lidstaten met het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland slechts een gedeelte te worden toegepast van het Schengenacquis dat geldt voor de betrekkingen van de betrokken lidstaten met de lidstaten die het Schengenacquis volledig toepassen.

The purpose of the regulation is to lay down common rules on the criteria and conditions for establishing a regime of local border traffic at the ‘external land borders’ of the Member States, i.e. the common land border between: a Member State and a neighbouring third country (e.g. the border between Poland and Ukraine); a Member State fully implementing the Schengen acquis and a Member State bound to apply such acquis in full but for which the Council decision authorising it to fully apply that acquis has not entered into force (e.g. the border between Austria and Hungary); or two Member States bound to apply the Schengen acquis in full but for which the Council decision authorising them to fully apply that acquis has not entered into force (e.g. the border between the Czech Republic and Poland).
Het verordeningsvoorstel heeft tot doel gemeenschappelijke regels vast te leggen met betrekking tot de criteria en voorwaarden om een regeling inzake klein grensverkeer aan de landbuitengrenzen van de lidstaten in te stellen, dat wil zeggen de gemeenschappelijke landgrenzen tussen een lidstaat en een aangrenzend derde land (bijv. de grens tussen Polen en Oekraïne), een lidstaat die het Schengenacquis volledig ten uitvoer legt en een lidstaat die dit acquis volledig moet toepassen, maar waarvoor het besluit van de Raad uit hoofde waarvan die staat wordt toegestaan dit acquis volledig toe te passen, nog niet in werking is getreden (bijv. de grens tussen Oostenrijk en Hongarije), of twee lidstaten die het Schengenacquis volledig moeten toepassen, maar waarvoor het besluit van de Raad uit hoofde waarvan die staten wordt toegestaan dit acquis volledig toe te passen, nog niet in werking is getreden (bijv. de grens tussen Tsjechië en Polen).

(5) Met de onderhavige verordening wordt, overeenkomstig het protocol tot opneming van het Schengenacquis in het kader van de Europese Unie, voortgebouwd op het Schengenacquis als omschreven in bijlage A van Besluit 1999/435/EG van de Raad van 20 mei 1999 tot vaststelling in overeenstemming met de desbetreffende bepalingen van het Verdrag tot oprichting van de Europese Gemeenschap en het Verdrag betreffende de Europese Unie, van de rechtsgrondslag van elk van de bepalingen of besluiten die het Schengenacquis vormen(4).
