2. At the request of the national regulatory authority, providers of electronic communications to the public, including providers of internet access services, shall make available to that national regulatory authority information relevant to the obligations set out in Articles 3 and 4, in particular information concerning the management of their network capacity and traffic, as well as justifications for any traffic management measures applied.

3. Member States shall ensure that the use of electronic communications networks to store information or to gain access to information stored in the terminal equipment of a subscriber or user is only allowed on condition that the subscriber or user concerned has access to clear and comprehensive information, inter alia about the purposes of the processing and is offered the right to refuse such processing by the data controller. This shall not prevent any technical storage or access for the sole purpose of carrying out or facilitating the transmission of a communication over an electronic communications network, or as strictly necessary in order to provide an information society service explicitly requested by the subscriber or user.
3. De lidstaten dragen er zorg voor dat het gebruik van elektronische-communicatienetwerken voor de opslag van informatie of voor het verkrijgen van toegang tot informatie die is opgeslagen in de eindapparatuur van een abonnee of gebruiker, alleen is toegestaan op voorwaarde dat de betrokken abonnee of gebruiker toegang heeft tot duidelijke en volledige informatie onder andere over de doeleinden van de verwerking, en het recht heeft om zich te verzetten tegen een dergelijke verwerking door de voor de verwerking verantwoordelijke.
