Ms. Marlene Catterall (Ottawa West—Nepean, Lib.): Mr. Speaker, I rise to present a petition from Canadians of Serbian origin who call upon parliament to amend the decision to participate in NATO military action against Yugoslavia, to call upon our allies in NATO to cease their participation in the undeclared war against Yugoslavia, and to support a peaceful solution to the crisis which is fair and acceptable to all sides.
Mme Marlene Catterall (Ottawa-Ouest—Nepean, Lib.): Monsieur le Président, je prends la parole pour présenter une pétition signée par des Canadiens d'origine serbe qui demandent au Parlement de revenir sur la décision de participer à l'action militaire de l'OTAN contre la Yougoslavie, d'exhorter nos alliés de l'OTAN à mettre fin à leur participation à la guerre non déclarée contre la Yougoslavie et d'appuyer une solution pacifique à la crise qui soit juste et acceptable pour tous.

45. Reiterates the importance of inclusive regional cooperation in the Western Balkans and welcomes Serbia's active participation in regional initiatives and bilateral meetings that promote good neighbourly relations, and its increasingly active role in fostering reconciliation in the region; welcomes the official visit by President Tadić to Bosnia and Herzegovina and his support for the territorial integrity and sovereignty of the country; calls on the Serbian Government to ensure that its direct relations with the authorities of the Republika Srpska are in line with this stated support and do not undermine the integrity, sovereignty, competences and effective functioning of the institutions of the state of Bosnia and Herzegovina; furthermore, urges the Serbian authorities to support reforms in BiH aimed at strengthening and streamlining the country's institutions with a view to EU-related reforms; calls on both governments to hold a special joint session in order to achieve better coordination in EU-related reforms; welcomes the initiatives and achievements with regard to improving political relations between Croatia and Serbia launched and brought about by Presidents Josipović and Tadić; reiterates that such positive bilateral relations are a good basis for resolving pending border issues and underlines that the lawsuits on genocide launched by the two countries against each other should not impede further progress in this regard; encourages the Serbian authorities to work closely with the countries of the former Yugoslavia and other neighbouring countries on the resolution of all outstanding problems of legal succession; encourages transborder cooperation with the neighbouring EU Member States Bulgaria, Hungary and Romania, including within the framework of the EU Strategy for the Danube Region;

In contrast, Croatia and Serbia must first haul their war criminals before the International Criminal Tribunal for the Former Yugoslavia in The Hague before the Copenhagen criteria can even come into play. While the unlawful regulations of the Anti-Fascist Council of the People’s Liberation of Yugoslavia (AVNOJ) and Beneš do not constitute grounds for blocking EU accession, the Serbian restitution policy certainly has to comply with EU stipulations.
À l’inverse, la Croatie et la Serbie doivent d’abord présenter leurs criminels de guerre au Tribunal pénal international de La Haye pour l’ex-Yougoslavie avant que les critères de Copenhague puissent entrer en jeu. Si les réglementations illégales de l’AVNOJ et les décrets Beneš ne suffisent pas pour bloquer l’accession à l’Union européenne, la politique serbe de restitution doit absolument respecter les clauses de l’UE.

Urges all Member States to collaborate fully in international criminal justice mechanisms, and especially in bringing fugitives to justice; in this regard, notes with satisfaction the cooperation of the Democratic Republic of the Congo in the transfer of Germain Katanga to the ICC, the cooperation of Serbia in the arrest and transfer of Zdravko Tolimir to the International Criminal Tribunal for the former Yugoslavia (ICTY) and the cooperation of Serbia and Montenegro in the arrest and transfer of Vlastimir Đjorđjević to the ICTY; however, notes with concern the persistent failure of Sudan to cooperate with the ICC by arresting and transferring Ahmad Muhammad Harun and Ali Muhammad Ali Abd-Al-Rahman; notes with concern that the ICC warrants for the arrest of four members of the Lord's Resistance Army in Uganda have not yet been executed; also notes with concern that Radovan Karadžić and Ratko Mladić remain at large and have not been brought before the ICTY; in this regard, calls on the Serbian authorities to ensure full cooperation with the ICTY, which should lead to the arrest and transfer of all remaining indictees, in order to open the way to the ratification of a Stabilisation and Association Agreement; considers further that the current proceedings brought against Liberia's former President, Charles Taylor, by the Special Court for Sierra Leone in The Hague constitute a significant development towards the ending of impunity;

- extension of the scope of the freeze of funds held abroad by the Federal Republic of Yugoslavia and Serbian Governments to cover individuals associated with President Milosevic and companies controlled by, or acting on behalf of the Federal Republic of Yugoslavia and Serbian Governments;
- étendre les mesures visant à geler les fonds détenus à l'étranger par les gouvernements de la République fédérale de Yougoslavie et de la Serbie aux particuliers proches du président Milosevic et aux sociétés qui soit sont contrôlées par le gouvernement de la République fédérale de Yougoslavie ou le gouvernement de la Serbie, soit agissent au nom de ceux-ci ;

We cannot support a policy which uses financial assistance to force the Federal Republic of Yugoslavia to behave like a banana republic politically and economically, while helping neither Serbian awareness of the crimes committed, notably by Milosevic, in the name of the Serbian people, nor the emergence of a state of law, nor indeed the credibility of the International Criminal Tribunal for the former Yugoslavia as a judicial authority independent of the political powers, nor yet the reconstruction of the country with a minimum of social cohesion and peaceful relations between neighbouring peoples.
Nous ne pouvons cautionner une politique qui manie l'aide financière pour imposer à la République fédérale de Yougoslavie un comportement de république bananière sur le plan politique et économique sans aider ni à l'ouverture des consciences serbes aux crimes commis notamment par Milosevic au nom du peuple serbe, ni à l'émergence d'un État de droit, ni d'ailleurs à la crédibilité du TPIY comme instance judiciaire indépendante des pouvoirs politiques, ni enfin à la reconstruction du pays avec un minimum de cohésion sociale et de rapports pacifiés entre les peuples voisins.

The unravelling of the former Federal Republic of Yugoslavia that led to both Croatian and Serbian genocide in Bosnia and the equally horrendous acts of inhumanity by citizens of Serbian and Albanian extraction in Kosovo is a sad tale looking for a lesson.
L'effondrement de l'ancienne République fédérale de Yougoslavie qui a entraîné le génocide perpétré par les Croates et les Serbes en Bosnie et les actes aussi horribles commis par citoyens de souche serbe ou albanaise au Kosovo est une triste fable dont il faut tirer une morale.
