The fixed number of hectares referred to in the first subparagraph of this paragraph shall be calculated by dividing the total number of eligible hectares declared pursuant to Article 33(1) or Article 36(2) by the young farmers applying for the payment for young farmers in 2015 by the total number of young farmers applying for that payment in 2015.

The new rules will include value sharing clauses to be negotiated by every product sector, and give farmers the right to ask for a written contract for the first time (unless trading with SMEs); Simpler risk management tools to help farmers, including a sector-specific income stabilisation tool and improvements to insurance schemes that will allow compensation of up to 70% for farmers whose production or income is cut by at least 20%; Clearer rules governing intervention in markets, allowing the Commission to act rapidly to address market failures without having to use public intervention or private storage measures; Greater flexibility for Member States to support specific sectors of economic, social or environmental importance through voluntary coupled support, even when these sectors are not in crisis; Clearer rules on support for farmers, notably through more flexibility on the definition of active farmers and stronger incentives for young farmers, with an increase in additional payments from 25% to 50% and guaranteeing all young farmers the right to the full five-year allowance for these payments, regardless of when they apply for them within their first five years of their setting-up; Improved environmental measures including simpler rules on crop diversification and the addition of three new types of ecological focus area focused on nitrogen-fixing crops, giving farmers and national authorities more options to suit their particular circumstances.

2. Without prejudice to the maximum of 2 % laid down in paragraph 1 of this Article, where the total amount of the payment for young farmers applied for in a Member State in a particular year exceeds the ceiling set pursuant to paragraph 4 of this Article, and where that ceiling is lower than that maximum, that Member State shall finance the difference by applying point (f) of the first subparagraph of Article 30(7) in the relevant year, by applying a linear reduction to all payments to be granted to all farmers in accordance with Article 32 or Article 36(2), or by both means.
2. It should be available to young farmers commencing their agricultural activity who are no more than 40 years of age in the year of the first submission of the application under the basic payment scheme or under the single area payment scheme.

Where Member States use the derogation provided for in the first subparagraph, for determining the date of setting up referred to in Article 50(2)(a) and Article 50(5) of Regulation (EU) No 1307/2013, the period in which the young farmer exercised control jointly together with other farmers in accordance with point (b) of the first subparagraph of paragraph 1 of this Article in the calendar years preceding the calendar year as of which the derogation is applied shall be taken into account.

In particular, point (b) of the first subparagraph of that provision provides that a young farmer needs to exercise effective and long-term control over the legal person in terms of decisions related to management, benefits and financial risks either solely or jointly together with other farmers.
