5. 5. These subsidiary requirements must satisfy the provisions set out in the Annex; these stipulate, inter alia, that: - the competence of the European Works Council will be limited to information and consultation on matters which concern the Community- scale undertaking or Community-scale group of undertakings as a whole or at least two of its establishments or group undertakings situated in different Member States; - the European Works Council will have a minimum of 3 members and a maximum of 30 members and, where its size so warrants, will elect from among its members a select committee of no more than 3 members; - four years after the European Works Council is established it shall examine whether to open negotiations for the conclusion of the agreement on the method of ensuring that employees are informed and consulted, or to continue to apply the subsidiary requirements adopted in accordance with the Annex; - the European Works Council will have the right to meet with the central management once a year, to be informed and consulted, on the basis of a report drawn up by the central management, of the progress of the business of the Community-scale undertaking or Community-scale group of undertakings and of its prospects; - where there are exceptional circumstances affecting the employees' interests to a considerable extent, particularly in the event of relocations, closures or collective redundancies, the select committee or, where no such committee exists, the European Works Council, will have the right to be informed; - the members of the European Works Council will inform the employees' representatives of the content and outcome of the information and consultation procedure; - the operating expenses of the European Works Council will be borne by the central management; in compliance with this principle, Member States may lay down budgetary rules regarding the operation of the European Works Council.

These could include, for example, assistance with regard to advice on training and assistance with regard to analysis of training needs; 3. encourage undertakings to give impetus to the continuing vocational training necessary for their development, taking account of the particular situation of the employees of the undertakings, particularly in order to promote, where appropriate, the measures described below; 4. make provision for specific incentives and technical support measures which are appropriate, necessary and adequate for undertakings facing industrial change, in order to encourage vocational training and retraining for their employees; 5. develop continuing vocational training in order to make it an important feature of regional and local development, taking into account the specific needs of employees and undertakings; support the establishment of partnerships, particularly at regional or local level, to analyse the requirements of undertakings and employees and to provide up-to-date information on training opportunities in order to match supply and demand as closely as possible; 6. impress on employers that they should inform their employees as soon as possible and, if necessary, at the time of their recruitment, about the undertaking's policy and activities in the field of continuing vocational training and staff development and about the terms of access to continuing vocational training, including the possibility of being assigned non-active status for the purpose of continuing vocational training; 7. support initiatives which enable workers who so desire to assess their continuing vocational training needs.

THE COUNCIL, with a view to promoting these principles, calls upon the Member States, taking into account the areas of responsibility of the competent authorities, of undertakings and of the two sides of industry respectively, and taking into account national laws and practice: - to increase their efforts at both national and Community level to improve the quality and attractiveness of vocational training and in particular to endeavour to secure the participation of undertakings in the vocational training of young people; - to take account of measures to improve the quality and attractiveness of vocational training in the reports they submit in the European context; the Commission to give lasting support to the efforts of the Member States and the two sides of industry with a view to achieving these goals, in particular by making use of education and training programmes, including those of the European Social Fund, as well as promoting dialogue on these matters within the European Union".

For example, taking into account the characteristics and extent of the crisis, such measures could: - adjust market capacity to demand, particularly by means of a temporary freeze on any increases in the number of Community, bilateral or national authorizations, provided these measures could not jeopardize the suppression of quotas from 1 January 1993; COM(90) 64 - 2 - - for a given period, limit the maximum tonnage authorized for each undertaking; - issue licences to transport operators entering the market which is in a state of crisis for the first time at a rate consonant with the capacity of the market or make the issuing of such licences subject to conditions such as the following: . the applicant must already have complied for a given period with the Community provisions on access to the occupation of road hauler; . over 50% of the assets of the transport undertaking in question must be financed from its own resources; . the operator must be independent of any transport undertaking already in the market in question; - make the registration of new vehicles conditional upon the operator taking out of service an amount of vehicles capacity at least equivalent to that of the new vehicles. - promote the conversion of transport undertakings, or the redeployment of their employees, to activities outside the market in question, with the provisor that these measures do not cause an imbalance elsewhere in the market; - encourage small and medium-sized undertakings to combine to reduce their logistical and management costs.
