(a) a taxpayer’s “basic herd” of any class of animals at a particular time means such number of the animals of that class that the taxpayer had on hand at the end of his 1971 taxation year as were, for the purpose of assessing the taxpayer’s tax under this Part for that year, accepted by the Minister, as a consequence of an application made by the taxpayer, to be capital properties and not to be stock-in-trade, minus the numbers, if any, required by virtue of this section to be deducted in computing the taxpayer’s basic herd of that class at the end of taxation years of the taxpayer ending before the particular time;

(c) the Minister shall, until the trust’s balance-due day for a subsequent taxation year, accept adequate security furnished by or on behalf of the trust on or before the trust’s balance-due day for the distribution year for the lesser of

The number of animals exported to third countries, according to Eurostat data or any other published official statistical information for that year accepted by the Commission, shall be added to each ceiling.

- The second proposal is that there should be a five-year time-bar on the recovery of sums owed to the Community. This limit could be extended in cases where active steps are being taken to secure recovery. As things stand, there is no general time-limit of a ‘Community’ nature (such a limit exists in certain sectoral regulations e.g. those concerning the Staff Regulations: 5 years, the regulation on the protection of the communities’ financial interests: 4 years). However, there is interference with the national legislation, where the contract refers to national law or where the judge is a national one applying his own law as the law of procedure. This could give rise to total chaos in those Member States where institutions’ right to collect debts is time-barred (after 3 or 10 years), or where, quite simply, no information is given on whether the deadline has lapsed until the case comes before the judge. Nor is it clear whether after the period has elapsed it is possible to accept compensation or spontaneous payment by the debtor. In brief, this proposal would introduce legal certainty for both the institutions and the debtors.
- La seconde consiste à prévoir un délai de prescription de cinq ans pour le recouvrement des créances communautaires -ce délai pouvant éventuellement être prolongé en cas de poursuites actives en vue du recouvrement: à l'heure actuelle, il n'y pas de délai général de prescription "communautaire" ( il y a un délai dans certains règlements sectoriels, par exemple en ce qui concerne le statut: 5 ans, le règlement PIF, protection des intérêts financiers: 4 ans, mais il y a interférence avec les droits nationaux applicables, car le contrat fait référence à ce droit national ou parce que le juge saisi est un juge national qui applique sa propre loi comme loi de procédure. Ceci aboutit à une cacophonie épouvantable dans certains États membres où la créance des institutions est prescrite après 3 ou 10 ans, ou encore l'on est simplement maintenue dans l'ignorance quant à savoir si la créance est prescrite, avant d'en saisir le juge. On ne sait pas non plus si après la prescription on peut encore compenser ou accepter un paiement spontané du débiteur. Bref, la proposition introduit de la sécurité pour les institutions et pour les débiteurs.

The Socialist Group, as well as the greater part of the Committee on Legal Affairs and the Internal Market was astonished at the attitude of the Council of Ministers, whose position is unacceptable in several respects. The suggestion that transposition periods for Member States should be increased to 15 years is the least acceptable element, given that the Commission’s original proposal was four years ago.
