In order to respect the principle of the independence of the police and that of not unduly disturbing or influencing ongoing investigations and criminal prosecutions, the O’Connor commission of inquiry recommended that the new commission should have the power to stay its activities if there was a risk of interfering with these investigations or prosecutions.55 The bill implements this recommendation by providing that the Commission must, on its own initiative or on the request of the Commissioner of the RCMP, suspend a review, investigation or hearing concerning a complaint if its members believe that its continuation would prejudice an ongoing criminal investigation or ongoing criminal proceedings (new section 45.72 of the RCMPA).
