Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. The appropriate frequency for the Member States to draw up these reports and submit them to the Commission should be five years; the first report should, exceptionally, cover a longer period; the structure of the reports should be consistent to facilitate their exploitation; they should be drawn up on the basis of a questionnaire drafted by the Commission after consulting the Advisory Committee on Safety and Health at Work and include relevant information on the preventive efforts deployed in the Member States so as to allow the Commission, taking into account any relevant findings of the European Agency for Safety and Health at Work and of the European Foundation for the Improvement of Living and Working Conditions, to adequately assess how the legislation works in practice.
Il paraît approprié de porter la périodicité de ces rapports et de leur transmission à la Commission par les États membres à cinq ans; à titre exceptionnel, le premier rapport devrait porter sur une plus longue période; la structure de ces rapports devrait être cohérente pour permettre leur exploitation; ces rapports devraient être rédigés à partir d’un questionnaire établi par la Commission après consultation du comité consultatif pour la sécurité et la santé sur le lieu de travail. Ils devraient comprendre des informations sur les efforts de prévention déployés dans les États membres, de façon à permettre à la Commission d’évaluer adéquatement la façon dont la législation fonctionne en pratique, en tenant compte de toute observation utile de l’Agence européenne pour la santé et la sécurité au travail et de la Fondation européenne pour l’amélioration des conditions de vie et de travail.

The obligations on the Member States to report on the practical implementation and on the Commission to draw up a report on the basis of the national reports are an important part of the legislative cycle, providing the opportunity to take stock of and evaluate the various aspects of the practical implementation of the Directives; it is therefore appropriate to extend this obligation to those directives that do not require reports, namely: Directive 2000/54/EC of the Parliament and of the European Council of 18 September 2000 on the protection of workers from risks related to exposure to biological agents at work (seventh individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC) , Directive 2004/37/EC of the European Parliament and of the Council of 29 April 2004 on the protection of workers from the risks related to exposure to carcinogens or mutagens at work (sixth individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC) and Council Directive 83/477/EEC of 19 September 1983 on the protection of workers from the risks related to exposure to asbestos at work (second individual Directive within the meaning of Article 8 of Directive 80/1107/EEC)
Les obligations imposées à la fois aux États membres de faire rapport sur la mise en œuvre pratique et à la Commission d’en faire sur la base des rapports nationaux constituent un moment important du cycle législatif qui permettent d’effectuer un bilan et une évaluation des différents aspects de la mise en œuvre pratique des dispositions des directives; il convient dès lors d’élargir cette obligation aux directives qui ne prévoient pas l’établissement de rapports, à savoir: la directive 2000/54/CE du Parlement européen et du Conseil, du 18 septembre 2000, concernant la protection des travailleurs contre les risques liés à l’exposition à des agents biologiques au travail (septième directive particulière au sens de l’article 16, paragraphe 1, de la directive 89/391/CEE) , la directive 2004/37/CE du Parlement européen et du Conseil, du 29 avril 2004, concernant la protection des travailleurs contre les risques liés à l’exposition à des agents cancérigènes ou mutagènes au travail (sixième directive particulière au sens de l’article 16, paragraphe 1, de la directive 89/391/CEE) , ainsi que la directive 83/477/CEE du Conseil, du 19 septembre 1983, concernant la protection des travailleurs contre les risques liés à une exposition à l’amiante pendant le travail (deuxième directive particulière au sens de l’article 8 de la directive 80/1107/CEE)
