Lorsqu'il est allégué, dans un cas régi par l'article 10 de la directive 92/50, qu'un marché aurait dû être passé conformément aux dispositions des titres III à VI de cette directive, il doit être démontré, à la satisfaction de la juridiction nationale, que, sur la base des informations qui ont été examinées ou auraient dû être examinées par le pouvoir adjudicateur et eu égard à la marge d'appréciation dont il dispose, la valeur du service figurant à l'annexe I A de la directive qui constitue une partie des services ayant fait l'objet du marché litigieux aurait dû être estimée par le pouvoir adjudicateur comme étant supérieure à la valeur du service relevant de l'annexe I B. 3) Sous réserve d'examiner, dans un cas concret approprié, la question de savoir si les dispositions pertinentes des titres III à VI de la directive 92/50 créent des droits au profit des particuliers qui sont inconditionnels et suffisamment précis pour pouvoir être invoqués en l'absence de mesures nationales de mise en oeuvre, le droit des prestataires de services au titre des articles 1er à 10 de la directive 92/50, envisagés dans leur ensemble, de participer à la passation de marchés publics de services dans le respect des dispositions de cette directive est un droit susceptible d'avoir un effet direct.

THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty establishing the European Community, Having regard to the Green Paper on the development of the single market for postal services, published on 11 June 1992; Having regard to the communication from the Commission on guidelines for the development of Community postal services; Whereas the development of postal services is an important feature of the development of the single market for the promotion of the economic and social development of the Community and its Member States; Whereas the provisions of the Treaty on the freedom to provide services cover the postal sector; Whereas the Green Paper and the abovementioned communication identify the aspects of postal services which are of Community interest; Whereas in view of these aspects it appears that efforts should be made at Community level to improve the efficiency and quality of postal services; Whereas the Commission has undertaken broad public consultation and has received contributions from interested parties in the postal sector; Whereas it is necessary to fix the main objectives of the development of postal services in the Community, in accordance with the Treaty; 1. GIVES ITS SUPPORT: to the general approach contained in the Commission's Green Paper on the development of the single market for postal services; 2. TAKES NOTE OF: the consultation which took place between the interested parties and the resulting Commission communication on the guidelines for developing Community postal services, certain aspects of which nevertheless remain to be considered in detail with a view to reaching an overall agreement; 3. REAFFIRMS: that a political agreement with the full participation of both the European Parliament and the Council is the best way of encouraging the implementation of the future Community policy in the postal sector; 4.
