KLE submits, first, that the Court of First Instance failed to comply with its obligation to state reasons, by not ruling on the complaint that the Commission had not established a structural relationship between the powers of the Agency and the Treaty and by not setting out the reasons why KLE would become dependent on supplies from the CIS and why the purchase price agreed in the contract did not correspond to market conditions.
KLE soutient, en premier lieu, que le Tribunal n'a pas respecté l'obligation de motivation à laquelle il est tenu en ne se prononçant pas sur le grief selon lequel la Commission n'a pas établi de relation systématique entre les compétences de l'Agence et le traité et en n'énonçant pas les raisons pour lesquelles la requérante serait devenue dépendante de livraisons en provenance de la CEI et le prix d'achat convenu au contrat ne correspondait pas aux conditions du marché.
