Out of five electrolysis installations in relation to which Member States reported in 2011 that they had granted exemptions, only two, in Sweden and Germany, remain in operation.

(2) In addition to the interest payable under subsection 161(1), where a taxpayer who is required by this Part to pay a part or instalment of tax has failed to pay all or any part thereof on or before the day on or before which the tax or instalment, as the case may be, was required to be paid, the taxpayer shall pay to the Receiver General interest at the prescribed rate on the amount that the taxpayer failed to pay computed from the day on or before which the amount was required to be paid to the day of payment, or to the beginning of the period in respect of which the taxpayer is required to pay interest thereon under subsection 161(1), whichever is earlier.

(3) Where a corporation is liable to pay tax under this Part and has failed to pay all or any part or instalment thereof on or before the day on or before which the tax or instalment, as the case may be, was required to be paid, it shall pay to the Receiver General interest at the prescribed rate on the amount that it failed to pay computed from the day on or before which the amount was required to be paid to the day of payment.

By 1 June 2011 Member States making use of this exemption shall provide a report to the Commission on the availability of asbestos free substitutes for electrolysis installations and the efforts undertaken to develop such alternatives, on the protection of the health of workers in the installations, on the source and quantities of chrysotile, on the source and quantities of diaphragms containing chrysotile, and the envisaged date of the end of the exemption.
Pour le 1er juin 2011, les États membres faisant usage de cette exemption communiquent à la Commission un rapport sur l’existence de substituts sans amiante pour des cellules d’électrolyse et les efforts entrepris pour la mise au point de tels substituts, sur la protection de la santé des travailleurs dans les installations, sur la source et les quantités de chrysotile, sur la source et les quantités de diaphragmes contenant du chrysotile, ainsi que la date programmée d’échéance de l’exemption.

However, Member States may exempt the placing on the market and use of diaphragms containing chrysotile (point (f)) for existing electrolysis installations until they reach the end of their service life, or until suitable asbestos-free substitutes become available, whichever is the sooner.
