A Member State which has granted type-approval shall withdraw such approval if the vehicle unit, motion sensor, record sheet or tachograph card which has been approved is not in conformity with this Regulation or if it displays any general defect during use which makes it unsuitable for the purpose for which it is intended.

The competent authorities of the Member State to which the application for type-approval has been submitted shall, in respect of each type of vehicle unit, motion sensor, model record sheet or tachograph card which they approve, send within one month a copy of the type-approval certificate accompanied by copies of the relevant specifications, including those relating to the seals, to the authorities of the other Member States.

The appellant considers that the CST, first, infringed the first paragraph of Article 43 of the Rules of Procedure of the CST by failing to take account of the fact that the submissions at issue were based on documents and information which the FRA produced only in the course of the proceedings before the CST and, second, failed to recognise that the submissions at issue must be held to be admissible on the ground that they were closely connected with other pleas submitted in the written procedure. Third, and in any event, the CST erroneously concluded, without any motivation, that the plea was not among the pleas which the Tribunal may raise of its own motion.

Consequently, in an action brought by a person covered by the Staff Regulations concerning the legality of an act adversely affecting him, the Civil Service Tribunal can, even of its own motion, in the exercise of its unlimited jurisdiction, award compensation to that person only if that compensation is designed to make good damage sustained by that person on account of the illegality of the act adversely affecting him and which forms the subject-matter of the action or, at least, damage resulting from an illegality which has a close link to that act.

52. The Commission also takes the view that, like national courts to which competition cases involving Articles 85 or 86 have been referred, national competition authorities applying those provisions are always at liberty, within the limits of their national procedural rules and subject to Article 214 of the Treaty, to seek information from the Commission on the state of any proceedings which the Commission may have set in motion and as to the likelihood of its giving an official ruling, pursuant to Regulation No 17, on cases which they are investigating on their own initiative.
52.
