35. 159 (1) For greater certainty, if a person who filed a claim for exemption under section 11 of the Hazardous Materials Information Review Act is, on the day on which section 147 comes into force, exempt under subsection 19(1) of that Act from a requirement in respect of which the exemption is claimed, the person continues to be so exempt after that day until the final disposition of the proceedings in relation to that claim.

The Commission shall inform the European Parliament and the Council without delay of the notification received by the Member States concerned and examine the notification taking into account the number of Member States affected by any of the situations described in paragraph 1 and the overall impact of the increases on the migratory situation in the Union as the latter appears from the data provided by the Member States as well as from reports prepared by FRONTEX and/or the European Asylum Support Office and, within three months following receipt thereof, the Commission shall send the results of its examination to the European Parliament and the Council, which shall give their opinion in a timely manner, after which the Commission may adopt an implementing decision suspending the exemption of visa requirement for the nationals of the third country concerned for a period of six months. The implementing decision shall be adopted in accordance with the procedure referred to in Article 4a (2).

I am therefore pleased that the European Parliament can now contribute to a procedure more in keeping with legal certainty: a humanitarian exemption from the freezing of funds and economic resources, of which the rapporteur has given an account. That is something for which the Member States, including Sweden, and the European Parliament have been working over a long period.

Under Council Regulation (EC) No 1911/91, the rates applicable varied between 0.1 and 5%, with the exemption of manufactured tobacco to which a rate of 15% applied. From 1996, these rates were reduced by 20% annually with a view to phasing out the tax completely. It is regrettable that the Commission’s proposal envisages rates of 5%, 15% and even 25%, which are much higher than those previously envisaged and which had been considerably reduced in respect of the APIM. Thus, between 31 July 2000 and 31 December 2001, the rate applicable to tobacco was 3.45%.

Instead of starting a process of consultation to identify which of the tax models currently in force in the Member States avoids double taxation of contributions and benefits with the greatest efficiency and the least bureaucracy, the report already comes down in favour of the EET regime, when it is obvious that the TEE tax system – which consists of taxing contributions to the plan and exempting pensions drawn from it – would guarantee uniform fiscal treatment, regardless of the country of residence of the member or retired person, that it would allow the country granting tax concessions for setting up occupational pension plans to safeguard its tax base, and that it would make the issue of sharing tax yields superfluous.

At the former Council meeting the Council was able to adopt the Visa Regulation which means that we will now have completely harmonised rules regarding which countries’ citizens are to be exempt from the requirement for a visa and to which countries this requirement is to apply in the future.
