The four conditions are: (a) the beneficiary of a State funding mechanism for an SGEI must be formally entrusted with the provision and discharge of an SGEI, the obligations of which must be clearly defined; (b) the parameters for calculating the compensation must be established beforehand in an objective and transparent manner, to avoid it conferring an economic advantage which may favour the recipient undertaking over competing undertakings; (c) the compensation cannot exceed what is necessary to cover all or part of the costs incurred in the discharge of the SGEI, taking into account the relevant receipts and a reasonable profit for discharging those obligations; and (d) where the beneficiary is not chosen pursuant to a public procurement procedure, the level of compensation granted must be determined on the basis of an analysis of the costs which a typical undertaking, well run, would have incurred in discharging those obligations, taking into account the relevant receipts and a reasonable profit.
Ces quatre conditions sont les suivantes: a) le bénéficiaire d'un mécanisme de financement d'un SIEG par l'État doit être formellement investi de l'exécution d'un SIEG dont les obligations doivent être clairement définies, b) les paramètres sur la base desquels sera calculée la compensation doivent être préalablement établis de façon objective et transparente, afin d'éviter qu'elle comporte un avantage économique susceptible de favoriser l'entreprise bénéficiaire par rapport à des entreprises concurrentes; c) la compensation ne peut dépasser ce qui est nécessaire pour couvrir tout ou partie des coûts occasionnés par l'exécution du SIEG en tenant compte des recettes y relatives ainsi que d'un bénéfice raisonnable lié à l'exécution de ces obligations et d) lorsque le choix du bénéficiaire n'est pas effectué dans le cadre d'une procédure de marché public, le niveau de la compensation nécessaire doit être déterminé sur la base d'une analyse des coûts qu'une entreprise moyenne, bien gérée, aurait encourus pour exécuter ces obligations en tenant compte des recettes y relatives ainsi que d'un bénéfice raisonnable.

3. Member States shall ensure that the provision set out in paragraph 2 is implemented, either through a contractual agreement between the competent authority and infrastructure manager covering a period of not less than three years which provides for State funding or through the establishment of appropriate regulatory measures with adequate powers.

Les États membres veillent à ce que la disposition prévue au paragraphe 2 soit mise en oeuvre soit dans le cadre d'un contrat conclu, pour une durée minimale de trois ans, entre l'autorité compétente et le gestionnaire de l'infrastructure et prévoyant le financement par l'État, soit par l'établissement de mesures réglementaires appropriées, prévoyant les pouvoirs nécessaires.
