If Europol receives information, including personal data, from a private person residing in a third country with which there is no international agreement concluded either on the basis of Article 23 of Decision 2009/371/JHA or on the basis of Article 218 TFEU, or which is not the subject of an adequacy decision as referred to in point (a) of Article 25(1) of this Regulation, Europol may only forward that information to a Member State or to a third country concerned with which such an international agreement has been concluded.

In particular, Article 218(6) TFEU provides that, except where an international agreement relates exclusively to the common foreign and security policy, the Council is to adopt the decision concluding the agreement in question after obtaining the consent of or consulting the European Parliament; all such international agreements which do not relate exclusively to the common foreign and security policy are therefore covered by this Interinstitutional Agreement.

The Bloc Québécois will raise this issue again and will bring forward proposals to restore democracy in the conclusion of international treaties. Such proposals will include requiring the government to present to the House all international treaties and agreements it has signed before ratifying them, requiring the government to publish all international agreements by which it is bound, requiring the vote and approval of the House following an analysis by a special committee tasked with examining international agreements and major treaties before the government may ratify them, and calling on the government to respect Quebec and provincial jurisdictions in the entire process of concluding treaties, that is, all stages of negotiation, signing and ratification.
Aussi, le Bloc québécois reviendra à la charge et fera des propositions pour restaurer la démocratie dans la conclusion des traités internationaux: obligation pour le gouvernement de présenter à la Chambre tous les traités et accords internationaux qu'il a signés avant de les ratifier; obligation pour le gouvernement de publier tous les accords internationaux auxquels il est lié; approbation et vote par la Chambre après analyse par un comité spécial chargé d'étudier les accords internationaux de tous les traités importants avant que le gouvernement puisse les ratifier; respect des compétences du Québec et des provinces dans l'ensemble du processus de conclusion des traités, c'est-à-dire à l'étape des négociations, de la signature et des rectifications.

For everyone’s benefit, I would first like to review what the Convention on the Protection and Promotion of the Diversity of Cultural Expressions will do; it will: recognize in international law the distinctive nature of cultural goods and services as vehicles of values, identity and meaning; clearly affirm of the right of countries to have cultural policies to ensure genuine diversity of cultural expressions domestically; include provisions by which developed countries undertake to support developing countries in nurturing the development of their own emerging cultural industries; assert the principle of non-subordination—meaning the legal status of the convention in international law will be equal to that of other international treaties, including trade agreements; commit countries to take the provisions of the convention into account not only when entering into other international agreements, but also when applying and interpreting agreements to which they are party; and include a basic dispute settlement mechanism, creating the potential that in the years ahead the convention will accumulate a body of written decisions on issues of cultural policy that will ultimately influence how culture is treated in trade agreements.
Avant toute autre chose, j'aimerais, pour le bénéfice de tous, rappeler ce que permettra la Convention sur la protection et la promotion de la diversité des expressions culturelles: reconnaître en droit international la nature spécifique des biens et services culturels en tant que porteurs de valeurs d'identité et de sens; affirmer clairement le droit des États de se doter de politiques culturelles visant à assurer une véritable diversité des expressions culturelles sur leur territoire; établir des dispositions par lesquelles les pays développés s'engagent à aider les pays en développement à soutenir le développement de leurs propres industries culturelles en émergence; établir le principe de non subordination qui donnera à la convention un statut en droit international égal à celui d'autres traités internationaux, notamment les accords de commerce; engager les pays à tenir compte des dispositions de la convention, non seulement lors de la négociation d'autres accords internationaux, mais également dans l'application et l'interprétation des accords auxquels ils sont parties; établir un mécanisme de base de règlement des différends qui, au fil des années, aura le potentiel de produire un corps de décisions sur les questions de politique culturelle et d'influer ainsi sur le traitement de la culture dans le cadre des accords de commerce.
