B. whereas Thulani Maseko, a lawyer working for the Trade Union Congress of Swaziland, was arrested on 17 March 2014 after writing an article criticising the lack of independence of the judicial system in Swaziland; whereas, on 19 March 2015, following the publication of a prison letter denouncing his conditions of detention, he was brought before a disciplinary committee in prison without the presence of a lawyer and was then forcefully moved to solitary confinement; whereas, although he has challenged this decision, no date has yet been announced for his High Court hearing;
B. considérant que Thulani Maseko, avocat travaillant pour le Congrès des syndicats du Swaziland, a été arrêté le 17 mars 2014 après avoir écrit un article dans lequel il critique le manque d'indépendance du système judiciaire du pays; considérant que, le 19 mars 2015, il a été traduit devant un comité de discipline en prison sans la présence d'un avocat puis placé de force en cellule d'isolement pour avoir écrit une lettre depuis sa prison, qui a été publiée et dans laquelle il dénonce ses conditions de détention; considérant que, bien qu'il ait fait appel de cette décision, aucune date n'a été annoncée concernant son audience devant la High Court;

D. whereas, on 17 July 2014, Thulani Maseko and Bheki Makhubu were convicted for contempt of court by the High Court of Swaziland and sentenced to two years’ imprisonment, a ruling which seems disproportionate compared with the usual sentence – 30 days’ imprisonment with the option of paying a fine – imposed in similar cases; whereas the judge presiding the trial, Mpendulo Simelane, had been named in one of the articles published by Mr Maseko’s newspaper, and whereas this represents a clear conflict of interest and an impediment to a fair trial;
D. considérant que, le 17 juillet 2014, Thulani Maseko et Bheki Makhubu ont été condamnés pour outrage à la Cour par la High Court du Swaziland et condamnés à deux ans d'emprisonnement, peine manifestement disproportionnée par rapport à celle habituellement prononcée dans des cas similaires, à savoir 30 jours d'emprisonnement avec possibilité de payer une amende; considérant que le juge présidant au procès, Mpendulo Simelane, avait été cité dans un des articles publiés par le magazine de M. Maseko, et qu'il y a donc là conflit d'intérêt flagrant et obstacle à la tenue d'un procès équitable;
