I. whereas the European Commission against Racism and Intolerance (ECRI), in its 2011 report on Spain, expresses its concern about the Constitutional Court’s 2007 decision declaring the criminalisation of Holocaust denial to be unconstitutional; whereas the judgment states that the simple, neutral denial of some facts without any intention to justify or incite violence, hatred or discrimination has no criminal relevance; whereas 4 of the 12 judges voted against the ruling; whereas ECRI has been informed that the local leader of the Popular Party has been promoting hate speech in Badalona, a city near Barcelona, for several years, accusing Romanian and Roma immigrants of being the cause of crime in the city; whereas civil society organisations have expressed concern about the ‘invisibility’ of racism and racial discrimination in Spain, as well as passivity and a lack of will to acknowledge and deal with the problem at lower levels of government; whereas the fact that there is no data available on racism or racial discrimination contributes to the impression that racism does not exist; whereas the hate crimes and discrimination service of the Barcelona prosecution office was set up in October 2009 following two highly publicised trials of owners of Barcelona bookstores who were selling publications justifying and promoting genocide; whereas, according to the authorities, there are no plans at present to reproduce this service in other Spanish cities and it is too early to evaluate its effectiveness;

K. whereas all states in CA benefit from the Generalised System of Preferences Plus scheme (GSP+), which will cease to apply on 31 December 2013; whereas the new GSP scheme will exclude, without exception, all the countries defined as upper-middle income countries by the World Bank, meaning that Costa Rica and Panama would lose their right to benefit from this system; whereas the GSP is unilateral, temporary, revisable, covers a smaller range of products and excludes most agricultural products, whereas the AA will improve the trading position of all CA states by establishing a new, more comprehensive, secure and mutually beneficial legal framework; whereas the fact that this new scheme will enable progressive liberalisation in the exchange of goods and services, public procurement and the promotion of investment is welcomed and whereas, since it involves an increased commitment, it should be geared towards stepping up the fight against poverty and exclusion, attaining the Millennium Development Goals (MDGs), the achievements made in upholding human rights and complying with international standards on society, labour and the environment;

We have seen a worrying trend in this 41st Parliament; it is as though amendments to legislation after first reading are somehow incremental defeats of the government of the day, whereas in fact it is common practice in Parliaments around the world, and certainly in the Canadian Parliament, to recognize that a bill at first reading is not perfect.
