WHEREAS an Association known as the Canadian Red Cross Society has been in operation for some years past, and was actively engaged during the late war in South Africa in contributing funds and tending the sick and wounded; and whereas the said association was in affiliation with the Society in England known as " The National Society for Aid to the Sick and Wounded in War" , and the work, operations and powers of the last named Society have now been transferred to and are being carried on, under the patronage of His Majesty King Edward the Seventh, by the British Red Cross Society, with which the Canadian Red Cross Society has now become affiliated; and whereas the International Conference of Geneva of 1863 recommended: " That there should exist in every country a Committee whose mission consists in co-operating in times of war with the hospital service of the armies by all means in its power" ; and whereas it is expedient that there should be a permanent organization in Canada in affiliation with the British Red Cross Society to carry out the purposes of the said treaty, and especially to secure supplies and to execute the humane objects contemplated by the said treaty, with the power to adopt and use the distinctive flag and badge specified by the said treaty in Article 7, on which shall be the sign of the Red Cross, and for the purpose of co-operating with the " Comité International de Secours aux Militaires Blessés" ; and whereas it is expedient that the existing association in Canada should be incorporated for the purposes aforesaid: Therefore His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:—
CONSIDÉRANT qu’une association connue sous le nom de The Canadian Red Cross Society a été en opération depuis quelques années, et a été activement engagée, pendant la dernière guerre dans le Sud-Africain, à contribuer des fonds et à prendre soin des malades et des blessés; considérant que la dite association était affiliée à la société en Angleterre, connue sous le nom de The National Society for Aid to the Sick and Wounded in War, et que les travaux, opérations et pouvoirs de la société nommée en dernier lieu ont été transférés à la British Red Cross Society et sont actuellement exercés, sous le patronage de Sa Majesté Édouard VII, par cette société, avec laquelle la Canadian Red Cross Society est maintenant affiliée; considérant que la Conférence Internationale de Genève de 1863 a recommandé : « qu’il devrait exister dans chaque pays un Comité dont la mission consiste à coopérer en temps de guerre avec le service d’hôpital des armées, par tous les moyens en son pouvoir »; considérant qu’il est à propos qu’il devrait exister en Canada une organisation permanente affiliée à la British Red Cross Society pour accomplir les fins du dit traité, et spécialement pour assurer les choses nécessaires et accomplir les objets humanitaires que le traité a en vue, avec le pouvoir d’adopter le drapeau distinctif et de porter l’insigne spécifiés en l’article 7 du dit traité, et sur lesquels paraît l’emblème de la Croix Rouge, dans le but de coopérer avec le « Comité International de secours aux militaires blessés »; et considérant qu’il est à propos que l’association existant actuellement en Canada soit constituée en corporation pour les fins ci-dessus énoncées : À ces causes, Sa Majesté, de l’avis et du consentement du Sénat et de la Chambre des Communes du Canada, décrète :

Whereas pursuant to paragraph eleven of the Terms of Union between the Dominion of Canada and the then Colony of British Columbia and to certain statutes of the Legislature of the Province of British Columbia, being chapter eleven of the statutes of the year eighteen hundred and eighty, chapter fourteen of the statutes of the year eighteen hundred and eighty-three, and chapter fourteen of the statutes of the year eighteen hundred and eighty-four, there were granted by the Province to Canada certain Crown lands in the Province by way of consideration for Canada’s undertaking to secure the construction of a railway to connect the seaboard of the Province with the railway system of Canada and of Canada’s paying to the Province from the date of the Union an annual sum of one hundred thousand dollars, the said Crown lands being defined in the statutes aforesaid and having become known as the Railway Belt and the Peace River Block;
Considérant que, en conformité du paragraphe onze des Conditions de l’Union entre le Dominion du Canada et la Colonie d’alors de la Colombie britannique, et de certaines lois de la Législature de la province de la Colombie britannique, étant le chapitre onze du statut de l’année mil huit cent quatre-vingt, le chapitre quatorze du statut de l’année mil huit cent quatre-vingt-trois, et le chapitre quatorze de l’année mil huit cent quatre-vingt-quatre, la province a concédé au Canada certaines terres de la Couronne situées dans la province en considération du fait que le Canada a entrepris d’assurer la construction d’un chemin de fer pour relier le littoral de la province au réseau ferroviaire du Canada, et vu que le Canada a versé à la province à compter de la date de l’Union une somme annuelle de cent mille dollars, lesdites terres de la Couronne étant définies dans les lois susdites et étant connues sous le nom de Zone du chemin de fer et du Bloc de la rivière La Paix;

AND WHEREAS, in order to give effect to the aforesaid conclusions, it is desirable that the Parliament of Canada should assent to the issue of a Royal Proclamation establishing the Royal Style and Titles for Canada:

Whereas it is anticipated that, in addition to the appropriation of public moneys of Canada hereby authorized, the various provincial governments, as well as municipal or other bodies, and many private individuals, will contribute generously to the aforesaid project;

D. whereas, in its aforesaid Communication on the Hague Programme, the Commission recognised that in the field of civil justice one key aspect that needs to be addressed is the recognition of public documents; whereas, in this respect, there is an urgent need to promote the recognition and enforcement of authentic acts, as defined in the Unibank judgment ,
D. considérant que la Commission a reconnu, dans sa communication précitée sur le programme de La Haye, que, en matière de justice civile, un aspect fondamental à aborder est la reconnaissance des actes publics; qu'il est nécessaire et urgent à ce titre de favoriser la reconnaissance et l'exécution des actes authentiques, tels que définis dans l'arrêt Unibank ,

A. whereas in its aforesaid Communication on the Hague Programme, the Commission singled out, as one of its priorities, the need to guarantee an effective European area of civil justice, not least as regards the recognition and enforcement of judicial decisions; whereas, with the aim of strengthening mutual trust within the European Union, this programme stated that continued implementation of the principle of mutual recognition was a main priority in the coming years, as mutual recognition is a specific means of protecting the rights of citizens and guaranteeing their application across borders in Europe,

Whereas there is a series of provisions concerning consumer protection and information to consumers; whereas Article 4 of Directive 98/6/EC of the European Parliament and of the Council of 16 February 1998 on consumer protection in the indication of the prices of products offered to consumers (5) states that price displays (sale price and price per unit) should be unambiguous, easily identifiable and clearly legible; whereas the aforesaid Article 4, in the light of recital 13 of the Directive, states that, in the interests of transparency, Member States can limit the number of prices which would have to be displayed in the national currency unit and in the euro unit; whereas recital 5 of Regulation (EC) No 1103/97 states that measures other than those contained in that Regulation and in the Regulation to be adopted under the third sentence of Article 109l(4) of the Treaty should be examined to ensure a balanced changeover, in particular for consumers;
6) considérant qu'il existe une série de dispositions relatives à la protection des consommateurs et à la fourniture d'informations aux consommateurs; que l'article 4 de la directive 98/6/CE du Parlement européen et du Conseil, du 16 février 1998, relative à la protection des consommateurs en matière d'indication des prix des produits offerts aux consommateurs (5), dispose que l'affichage des prix (prix de vente et prix à l'unité de mesure) doit être non équivoque, facilement identifiable et aisément lisible; que ledit article 4, eu égard au treizième considérant de la directive, précise que, dans l'intérêt de la transparence, les États membres peuvent limiter le nombre de prix qui devront être affichés en unité monétaire nationale et en euros; que le cinquième considérant du règlement (CE) n° 1103/97 explique qu'il y a lieu d'étudier d'autres mesures que celles qui sont prévues par ce règlement et par celui qui doit être adopté sur la base de l'article 109 L, paragraphe 4, troisième phrase, afin d'assurer un passage équilibré à la monnaie unique, notamment pour les consommateurs;
