The former reinforces guarantees safeguarding the fundamental right to asylum, in particular, by strengthening the right to access asylum procedures (Articles 18 and 19), whereas the latter includes improved and clearer standards to more effectively safeguard the fundamental right to dignity, especially as regards vulnerable asylum seekers and further harmonises the rules on detention, laying down clear and restrictive grounds, conditions for detention, and guarantees for detainees (Articles 1, 4, 6, 7, 18, 21, 24, and 47).
La première renforce les garanties protégeant le droit fondamental à l’asile, notamment en renforçant le droit d’accès aux procédures d’asile (articles 18 et 19), alors que la seconde introduit des normes améliorées et plus claires afin de protéger plus efficacement le droit fondamental à la dignité, particulièrement pour les demandeurs d’asile vulnérables et harmonise davantage les règles relatives à la rétention, définissant des motifs clairs et restrictifs, des conditions de rétention ainsi que des garanties pour les personnes placées en rétention (articles 1er, 4, 6, 7, 18, 21, 24, et 47).

B. whereas the individual, citizen or resident, must be at the centre of the European Union, and whereas fundamental rights protect any individual against possible interference, abuse and violence by authorities – at all levels – with respect to their private life and their rights and freedoms; and whereas respect for and promotion of human rights, fundamental freedoms, democracy and the values and principles enshrined in the EU treaties and international human rights instruments (UDHR, ECHR, ICCPR, ICESCR, etc.) must be at the centre of European integration;
B. considérant que l'individu, citoyen ou résident, doit être au centre du projet européen et que les droits fondamentaux le protègent contre les possibles interférences, abus et violences des autorités – à tous les niveaux – sur la sphère de sa vie privée et de ses libertés et droits, et que le respect et la promotion des droits de l'homme, des libertés fondamentales, de la démocratie et des valeurs et principes énoncés dans les traités de l'Union et les instruments internationaux relatifs aux droits de l'Homme (DUDH, CEDH, PIDCP, PIDESC, etc.), doivent être au centre de la construction européenne;

whereas the right of access to documents is a fundamental right, protected by the Charter of Fundamental Rights and the Treaties and implemented by Regulation (EC) No 1049/2001, with the aim, in particular, of ensuring that this right can be exercised as easily as possible, and of promoting good administrative practices regarding access to documents by ensuring democratic scrutiny of the activities of the institutions and ensuring that they comply with the rules enshrined in the Treaties.
considérant que le droit d'accès aux documents est un droit fondamental consacré par la charte des droits fondamentaux et par les traités, que le règlement (CE) no 1049/2001 met en œuvre dans le but, notamment, de garantir l'exercice le plus aisé possible de ce droit et d'encourager les bonnes pratiques administratives en matière d'accès aux documents, en assurant un contrôle démocratique sur les activités des institutions et sur leur respect des principes établis dans les traités.

whereas ICT, like any technology, can be used and abused to threaten women, their rights and freedoms, and ultimately their empowerment, such as in the case of cyber-bullying, cyber-stalking, trafficking in human beings, hate speech, incitement to hatred, discrimination and violation of fundamental rights; whereas anonymity on the internet contributes to the proliferation of these forms of violence against women; whereas such new challenges and risks need to be identified and addressed appropriately by policymakers, as well as by enterprises, companies and civil society organisations, while providing room for information exchange on the internet.

whereas some 6,6 million children under the age of 5 died in 2012, mostly from preventable causes, and were thus deprived of their fundamental right to survive and develop; whereas 168 million children aged 5 to 17 are engaged in child labour, which compromises their right to be protected from economic exploitation and infringes their right to learn and play; whereas 11 % of girls are married before they turn 15, which jeopardises their rights to health, education and protection; whereas in sub-Saharan Africa 1 in every 10 children born still dies before their 5th birthday.

whereas education — specifically free primary schooling for all children — is a fundamental right to which governments committed themselves under the 1989 UN Convention on the Rights of the Child; whereas the target for 2015 is to ensure that all boys and girls complete a full course of primary schooling; whereas despite some progress in the developing world, this goal is far from being achieved.
considérant que l'éducation — en particulier, l'enseignement primaire gratuit pour tous les enfants — est un droit fondamental sur lequel les gouvernements se sont engagés dans le cadre de la convention des Nations unies relative aux droits de l'enfant de 1989; que l'objectif pour 2015 est que tous les enfants, garçons et filles, aient les moyens d'achever un cycle complet d'études primaires; que malgré certains progrès accomplis dans les pays en développement, cet objectif est loin d'être atteint.

Firstly, for the achievement of its economic and monetary-policy objectives, the Union has hard law, specific objectives, penalties if need be, large amounts of money and tough action; whereas fundamental rights and freedoms at European level have only soft law.
Une première irritation, car on est bien forcé de constater que pour réaliser ses objectifs de politique économique et monétaire, l’Union dispose de législations contraignantes, d’objectifs spécifiques, au besoin de sanctions, de fonds importants et de mesures strictes, ce que nous appellerons hard law (en anglais dans le texte), alors que dans le domaine des libertés et des droits fondamentaux elle est obligée de se débrouiller avec des dispositions non contraignantes, ce que nous appellerons soft law (en anglais dans le texte).
