P. whereas, according to its opinion of 2 February 2002, the Commission’s Scientific Committee on Food did not consider it appropriate to use thujone as a chemically identified flavouring substance and supported the application of the upper limits in foods and beverages which were in place at the time of adoption of the opinion and which remain in place pursuant to Annex III to Regulation (EC) No 1334/2008;
P. considérant que, dans son avis rendu le 2 février 2002, le Comité scientifique de l'alimentation humaine de la Commission a estimé que l'utilisation de la thuyone comme substance aromatisante chimiquement identifiée n'était pas appropriée, et qu'il a soutenu l'application des plafonds en vigueur à la date d'adoption de l'avis pour son utilisation dans les aliments et les boissons, lesquels restent en vigueur conformément aux dispositions de l'annexe III du règlement (CE) n° 1334/2008;

C. whereas the definition of flavourings given in the directives is vague inasmuch as it stipulates that, if a flavouring has been obtained from a substance or preparation present in material of animal or vegetable origin, it has to be termed a ‘natural flavouring’;

Whereas, however, the circulation of some of this information should be restricted; whereas the development of certain new flavouring substances and the manufacture of certain existing flavouring substances calls for heavy investment by manufacturers in research and production; whereas flavouring substances which are not inventions cannot be patented; whereas the development and manufacture of such flavouring substances nonetheless amount to trade secrets which have to be protected against acts of counterfeiting and unfair competition;
considérant qu'il convient néanmoins de limiter la diffusion de certaines de ces informations; que, en effet, le développement de certaines nouvelles substances aromatisantes ainsi que la fabrication de certaines substances aromatisantes existantes exigent des fabricants de substances aromatisantes des investissements coûteux en matière de recherche et de production; que les substances aromatisantes qui ne sont pas des inventions ne peuvent faire l'objet d'un brevet; que le développement et la fabrication de ces substances aromatisantes constituent néanmoins des secrets de fabrication devant faire l'objet d'une protection contre les actes de contrefaçon et de concurrence déloyale;

(12) Whereas flavouring substances which are actually used in the Member States and the use of which cannot be challenged by any of the latter pursuant to the general rules of the Treaty should initially be listed in a register; whereas such registration does not come under Article 7 of Directive 88/388/EEC and does not, therefore, call for the intervention of the Scientific Committee for Food at this stage;
(12) considérant qu'il convient, dans un premier temps, de réunir dans un répertoire les substances aromatisantes effectivement employées dans les États membres et dont l'utilisation ne saurait, en vertu des règles générales du traité, être contestée par l'un ou l'autre de ceux-ci; qu'un tel constat ne relève pas de l'article 7 de la directive 88/388/CEE et ne requiert donc pas, à ce stade, l'intervention du comité scientifique de l'alimentation humaine;

Whereas pursuant to Article 3(1) of Regulation (EC) No 2232/96 of the European Parliament and of the Council of 28 October 1996 laying down a Community procedure for flavouring substances used or intended for use in or on foodstuffs (1), the Member States (2) must notify the Commission of the list of flavouring substances which may be used in or on foodstuffs marketed on their territory; whereas these flavouring substances and the technical data relating to them are initially communicated to the competent authorities of the Member States by their manufacturer; whereas under the first subparagraph of Article 3(2) and Article 4(1) of Regulation (EC) No 2232/96 this information may be entered in a register and in an evaluation programme made public; whereas, moreover, a number of persons should have access to this information throughout the Community procedure set up by the Regulation;
considérant que, en application de l'article 3, paragraphe 1, du règlement (CE) n° 2232/96 du Parlement européen et du Conseil du 28 octobre 1996 fixant une procédure communautaire dans le domaine des substances aromatisantes utilisées ou destinées à être utilisées dans ou sur les denrées alimentaires (1), les États membres (2) notifient à la Commission la liste des substances aromatisantes qui peuvent être utilisées dans ou sur les denrées alimentaires commercialisées sur leur territoire; que ces substances aromatisantes et les données techniques les concernant sont initialement communiquées aux autorités compétentes des États membres par les fabricants de ces substances aromatisantes; que ces informations peuvent être consignées, en application de l'article 3, paragraphe 2, premier alinéa, et de l'article 4, paragraphe 1, du règlement (CE) n° 2232/96, dans un répertoire et dans un programme d'évaluation rendus publics; que, par ailleurs, tout au long de la procédure communautaire mise en place par le règlement, un certain nombre de personnes devraient avoir accès à ces informations;

Whereas the Community legislature has taken account of this fact by requiring in the second subparagraph of Article 3(2) of Regulation (EC) No 2232/96 that these flavouring substances be 'designated in such a way as to protect the intellectual property rights of their manufacturer`; whereas this need to protect intellectual property is also referred to in recital 14 of the preamble to that Regulation; whereas this requirement applies not only to flavouring substances notified pursuant to Article 3(1) of the Regulation but also in the future to new flavouring substances as referred to in Article 5(2) thereof; whereas this requirement applies at all stages of the Community procedure set up by the Regulation;
considérant que le législateur communautaire a tenu compte de cet état de fait en prévoyant, à l'article 3, paragraphe 2, deuxième alinéa, du règlement (CE) n° 2232/96, que ces substances aromatisantes seront désignées «de manière à protéger la propriété intellectuelle de leur fabricant»; que cette nécessité de protéger la propriété intellectuelle est également mentionnée au considérant 14 du même règlement; que cette nécessité s'impose non seulement aux substances aromatisantes notifiées en application de l'article 3, paragraphe 1, du règlement, mais aussi dans l'avenir aux nouvelles substances aromatisantes visées à l'article 5, paragraphe 2, du règlement; qu'elle s'impose en outre à toutes les étapes de la procédure communautaire mise en place par le règlement;

Whereas the use of flavouring substances identical to natural flavouring substances and the addition of alcohol in the production of certain aromatized drinks should be permitted under certain circumstances in particular in order to conform to the traditions and customs of the various regions of the Community;
considérant qu'il convient de permettre, sous certaines conditions, l'utilisation de substances aromatisantes identiques aux naturelles et l'addition d'alcool dans la fabrication de certaines boissons aromatisées, notamment pour se conformer aux traditions et usages en vigueur dans certaines régions de la Communauté;
