Whereas the day determining the applicable refund rate should be fixed; whereas that day should be linked in the first instance to the time at which the cereals are placed under control and, for the quantities distilled subsequently, to each fiscal distillation period; whereas before the refund is paid proof must be furnished in the form of a distillation declaration that the cereals have been distilled; whereas such a declaration must contain the information necessary for the calculation of the refunds; whereas the first day of each fiscal distillation period may also be the operative event for the agricultural conversion rate pursuant to Article 6 of Regulation (EEC) No 3813/92;

Whereas the usual system of refunds should, as far as possible, be applied on a similar basis; whereas a refund should therefore be paid for cereals meeting the conditions provided for in Article 9 (2) of the Treaty used pro rata in terms of the quantities of spirit drinks exported; whereas, to this end, the quantities of such distilled cereals should be multiplied by an overall, flat-rate coefficient calculated on the basis of national statistics supplied by the Member States concerned; whereas use of the ratio between the total quantities of spirit drinks concerned which have been exported and the total quantities which have been sold seems to afford a fair and simple basis; whereas it is necessary to define what is meant by 'total quantities exported' and 'total quantities marketed'; whereas, for the purpose of determining the quantities of cereals distilled and the coefficient, the quantities subject to inward processing arrangements should be excluded;

Whereas Commission Regulation (EEC) No 117/90 (3) opens compulsory distillation of table wine as provided for in Article 39 of Regulation (EEC) No 822/87 for the 1989/90 wine year; whereas the percentages of table wine production to be delivered for such distillation by each producer subject to compulsory distillation were fixed on 27 February 1990 by Commission Regulation (EEC) No 488/90 (4);
considérant que le règlement (CEE) no 117/90 de la Commission (3) a ouvert la distillation obligatoire des vins de table prévue à l'article 39 du règlement (CEE) no 822/87 pour la campagne 1989/1990; que les pourcentages de la production de vin de table à livrer à cette distillation par chaque assujetti ont été arrêtés le 27 février 1990 par le règlement (CEE) no 488/90 de la Commission (4);

Whereas, in accordance with Article 41 (7) of Regulation (EEC) No 337/79, distillers may either receive aid in respect of the product to be distilled or deliver the product obtained from distillation to the intervention agency; whereas the amount of the aid must be fixed on the basis of the criteria referred to in Article 16 of Council Regulation (EEC) No 2179/83 (5), as amended by Regulation (EEC) No 2687/84 (6); whereas, to avoid production of wine spirits of mediocre quality and since there are no Community provisions on the subject, it should be laid down that wine spirits produced must comply with national provisions in force;

Whereas Commission Regulation (EEC) No 2395/84 (3) specifies the maximum actual alcoholic strength to be taken as a basis for calculating the price in the 1984/85 wine year for wine sent for distillation under one of the schemes referred to in Articles 11, 15 and 41 of Regulation (EEC) No 337/79, where the producer of the wine has increased the alcoholic strength by adding sucrose or concentrated grape must in respect of which aid has been received under Article 14 of Regulation (EEC) No 337/79; whereas the same maximum actual alcoholic strength should be laid down for calculating the aid for the product resulting from the distillation and the quantity of alcohol which may be taken over by the intervention agency in respect of the distillation referred to in Article 41 of Regulation (EEC) No 337/79;
