Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Many drug users take more than one type of psychoactive substance. The main diagnosis should be classified, whenever possible, according to the substance or class of substances that has caused or contributed most to the presenting clinical syndrome. Other diagnoses should be coded when other psychoactive substances have been taken in intoxicating amounts (common fourth character .0) or to the extent of causing harm (common fourth character .1), dependence (common fourth character .2) or other disorders (common fourth character .3-.9). 2. Where the third country concerned has given a legal undertaking to provide the assistance required to gather evidence of the irregular nature of transactions which appear to contravene legislation on excise duties, information obtained under this Regulation may be communicated by the competent authority of a Member State to that third country, in accordance with that Member State’s national law regarding transfers of personal data to third countries, for the purposes of the correct application of excise duties or similar taxes, duties and charges applicable in the third country with the consent of the competent authorities which supplied the information, in accordance with their national law.
2. Lorsque le pays tiers concerné s'est juridiquement engagé à fournir l'assistance nécessaire pour réunir des éléments de preuve du caractère irrégulier d'opérations qui paraissent être contraires à la législation relative aux droits d'accise, les informations obtenues en application du présent règlement peuvent être communiquées par l'autorité compétente d'un État membre audit pays tiers, conformément à la législation nationale de cet État membre relative aux transferts de données personnelles aux pays tiers, aux fins de l'application correcte des droits d'accise ou de taxes similaires, impôts, droits et prélèvements applicables dans un pays tiers avec l'accord des autorités compétentes qui ont fourni les informations, conformément à leur législation nationale.

The definition of marketing should also be amended in order to give professional investors the freedom to choose the funds in which they wish to invest, including third-country funds subject to compliance with the same conditions applying to the marketing of AIF established in a third country by the third country where the third-country funds are established.

(5) To prevent the employment of illegally staying third-country nationals, employers should be required before recruiting a third-country national, including in cases where the third-country national is being recruited for the purpose of posting to another Member State in the context of the provision of services, to check that they have a valid residence permit or another authorisation for stay showing that the third-country national is legally staying on the territory of the Member State.
(5) Pour prévenir l'emploi de ressortissants de pays tiers en séjour irrégulier, les employeurs devraient être tenus de vérifier, avant de recruter des ressortissants de pays tiers, que ces derniers disposent d'un permis de séjour valable ou d'une autre autorisation équivalente indiquant qu'ils se trouvent en séjour régulier sur le territoire de l'État membre considéré, y compris dans le cas de ressortissants de pays tiers recrutés aux fins de détachement dans un autre État membre dans le contexte d'une prestation de services.

In the light of such information and/or reports, a decision may be made to suspend inclusion, in accordance with the procedure referred to in Article 14(2) of Regulation (EEC) No 2092/91; a similar decision may also be made in cases where a third country has not supplied the information requested by the final date specified in the Commission’s request or where a third country has not agreed to an on-the-spot investigation to establish compliance with the conditions for inclusion.

A number of disparities are still present and, not least, where some third countries are concerned, there is no desire for reciprocity of this kind.
