However, I fully agree with what the rapporteur has said, which is also stressed in the amendments adopted in committee. They firmly reiterate the opinion, often expressed by Parliament, that it is becoming increasingly necessary to communitise the instruments of judicial cooperation and to consolidate the judicial and democratic control of these instruments, which are, in fact, quite vital.
Cependant, on peut tout à fait partager ce que le rapporteur nous a dit ici, et qui est également souligné par les amendements approuvés en commission, qui rappellent avec force l'opinion, plusieurs fois exprimée par ce Parlement, selon laquelle il est de plus en plus nécessaire d'arriver à la communautarisation des instruments de coopérations judiciaire, au renforcement du contrôle juridictionnel et au renforcement du contrôle démocratique de ces instruments malgré tout indispensables.

What I would like to stress here today, from my own point of view, is that this opinion must not only enshrine clear, unambiguous legislation on guarantees to protect defendants and on the conditions in which the confidentiality of the legal professions – and of lawyers in particular– may be legitimately exercised. Above all, what needs to be stressed is the fact that the same definition should apply to all judicial instruments.
Ce que je voudrais souligner aujourd'hui, de mon point de vue, c'est que cet avis doit non seulement consacrer une règle claire et non ambiguë sur les garanties de la défense des justiciables et sur les conditions d'exercice légitime du secret des professions juridiques - spécialement celle d'avocat -, mais surtout je voudrais souligner que tous les instruments juridiques devraient avoir la même définition.

The idea of including this issue on the agenda we are discussing today was still on the agenda of the Helsinki Summit, is still being advocated by various Member States and by the courts themselves, and is being kept alive in the European Parliament, whose Committee on Legal Affairs and the Internal Market is preparing what I think will be a high-quality opinion on the nature and the extent of judicial reform.
L'idée de faire inscrire ce problème à l'ordre du jour discuté aujourd'hui s'est maintenue jusqu'au sommet d'Helsinki et est encore défendue par différents États membres, par les tribunaux eux-mêmes. Elle est encore vive au sein du Parlement européen, dont la commission juridique prépare un avis, de grande qualité selon moi, sur la nature et la portée de la réforme juridictionnelle.
