Before the entry into force of the Lisbon Treaty, investment was a policy field with a specific division of work between the EU and its Member States. Their roles in shaping investment policies were complementary: whilst the EU pursued the liberalisation of foreign direct investment, in particular through its trade agreements with non-EU countries, the Member States used to seek the protection of investment flows, by concluding Bilateral Investment Treaties.
Avant l’entrée en vigueur du traité de Lisbonne, les investissements étaient un domaine de compétence partagée entre l’UE et ses États membres, qui jouaient des rôles complémentaires dans la définition des politiques: tandis que l’UE poursuivait la libéralisation des investissements directs étrangers, notamment par le biais de ses accords commerciaux avec les pays tiers, les États membres s’attachaient à protéger les flux d’investissement en concluant des traités bilatéraux d’investissement.
