While in no way binding, these recommendations are intended to supplement Title III of the Rules of Procedure of the Court of Justice (Articles 93 to 118) and to provide guidance to the courts and tribunals of the Member States as to whether it is appropriate to make a reference for a preliminary ruling, as well as practical information concerning the form and effect of such a reference.

Calls on the Council and the Commission to adopt and implement, as part of the EU’s 2030 framework for climate and energy policies, a multi-faceted approach based on mutually reinforcing, coordinated and coherent policies and ambitious binding targets for the reduction of greenhouse gas emissions, renewable energy sources and energy efficiency; asks the Commission and the Member States to take greater advantage of the interactions between these three targets, since they are the most appropriate tools for achieving the EU’s climate and energy objectives in a cost-effective way in the time horizon to 2030, providing investment certainty, and boosting and strengthening competitiveness and energy security in the EU;

The EESC regrets, however, the ambiguous way in which chapters IV and V of the proposed Regulation have been drafted, in particular when it comes to the subjective factors on which certain consumer rights continue to depend; it was hoped that these would become binding guarantees, and this concerns especially Articles 23(3), 27, 28 and 30 of the proposal.

Stresses that the latest developments at international level have clearly demonstrated that it is even more imperative than ever to meet the 20% energy efficiency target; proposes that the target be met with the help of a mix of instruments including EU and national measures, such as tax incentives, loans on specially favourable terms, indirect subsidies, changes to rent law, guidelines in connection with public invitations to tender and the laying down of standards; reiterates its call for mandatory energy efficiency targets for Member States and calls for the 20% target to be translated as quickly as possible into targets for the Member States and for these to be laid down in a legally binding way; recognises that, pursuant to the subsidiarity principle, Member States must, however, be allowed room for manoeuvre in choosing the means they will use;

In the same way, given that the proposal for a directive lays down certain minimum common standards, it is important not to give the impression that these might prevent the Member States from implementing more favourable provisions in this area, as long as these provisions are compatible with the directive. At the same time, any more favourable standards contained in international legal instruments and agreements binding on the European Community and its Member States should also apply.
