IN-CONTEXT TRANSLATIONS

By electronic notification of 28 March 2008, registered the same day at the Commission, Germany notified to the Commission, in line with the individual notification requirement resulting from the Guidelines on national regional aid for 2007-2013 (2) (hereinafter RAG), its intention to provide regional aid for a large investment project in favour of Deutsche Solar AG, for the setting-up of a plant to produce solar wafers in Freiberg, Saxony, Germany.
Par le biais d’une notification soumise par voie électronique le 28 mars 2008 et enregistrée le même jour, l’Allemagne a fait part à la Commission, conformément à l’obligation de notification individuelle prévue par les lignes directrices concernant les aides d’État à finalité régionale pour la période 2007-2013 (2) (ci-après les «lignes directrices de 2007» ou «l’encadrement de 2007»), de son intention d’accorder à l’entreprise Deutsche Solar AG une aide régionale en faveur d’un grand projet d’investissement visant à la création d’une usine de production de wafers photovoltaïques à Freiberg (Saxe, Allemagne).

Germany notified aid for a large investment project by DS, consisting in the setting-up of a new plant for the production of multi-crystalline solar wafers in Freiberg East. The new plant is planned to have a nominal annual capacity of 500 Megawatt peak (MWp) (5).
L’Allemagne a notifié une aide d’État en faveur d’un grand projet d’investissement de DS ayant pour objet la réalisation à Freiberg-Est d’une nouvelle usine de fabrication de wafers photovoltaïques polycristallins d’une capacité nominale annuelle de 500 mégawatts crête (MWc) (5).

The European Commission has authorised €45 million of regional investment aid for the German company Deutsche Solar AG for the production of solar wafers in Freiberg, Germany.

It is, however, not to be excluded that the new project would form a single investment project with previous investments undertaken by the SolarWorld group in Freiberg, for the production of solar wafers (see IP/10/897), in which case the total aid granted for the combined investments would exceed the notification threshold for regional aid to large investment projects.

With its initial comments, Germany also submitted updated information on the investment projects undertaken by DS in Freiberg South and East within 3 years from the start of the notified project: previously to the project P3 (extension of solar wafer production capacity from 350 to 500 MWp) in Freiberg South, another project P2 (previous extension of solar wafer production capacity from 270 to 350 MWp) had been undertaken at the same site.
Conjointement à ses observations initiales, l’Allemagne avait également transmis des informations actualisées sur les projets d’investissement réalisés par DS à Freiberg-Sud et -Est depuis le démarrage du projet notifié. Avant d’envisager le projet P3 (extension de la capacité de production de wafers photovoltaïques de 350 à 500 MWc) à Freiberg-Sud, DS avait déjà procédé à la réalisation du projet P2 (extension précédente portant la capacité de production de 270 à 350 MWc) pour la même usine de fabrication.

In line with point 69 of the RAG (where the project concerns an intermediate product and a significant part of the output is not sold on the market, the product concerned may be the downstream product), since the Commission could not exclude that the solar wafers produced in Freiberg East would not, at least partly, be used internally by the beneficiary group for further production into solar cells or solar modules, the Commission took the view, in its decision opening the formal investigation procedure, that the product concerned by the notified project was thus not only solar wafers but also solar cells and solar modules.
Il était impossible à la Commission d’exclure que le groupe bénéficiaire n’utilise pas, au moins partiellement en interne, les wafers photovoltaïques fabriqués à Freiberg-Est pour les transformer en cellules ou modules solaires. C’est ce qui explique qu’en conformité avec le point 69 des lignes directrices de 2007, selon lequel le produit considéré peut également être le produit en aval lorsque le projet porte sur un produit intermédiaire et qu’une partie importante de la production n’est pas commercialisée, la Commission a estimé, dans sa décision d’ouverture, que le produit concerné par le projet d’investissement notifié n’était pas seulement constitué de wafers photovoltaïques, mais également de cellules photovoltaïques et de modules solaires.

At the time of the notification, Germany informed the Commission on aid to be granted for another DS investment (project P3 in Freiberg South) started almost simultaneously with the notified project (on 1 September 2007), for the extension of its existing solar wafer plant from 350 to 500 MWp.
Lors de la notification précitée, l’Allemagne avait informé la Commission qu’elle envisageait également d’octroyer une aide à DS pour un autre projet d’investissement (P3 à Freiberg-Sud) dont le démarrage serait pratiquement simultané à celui du projet notifié (à savoir le 1er septembre 2007) et permettrait d’élargir la capacité d’une usine de wafers photovoltaïques déjà existante de 350 à 500 MWc.

“The solar wafer plant is expected to create new jobs in Freiberg and will contribute to the development of the region without unduly distorting competition," said Commission Vice President and Competition Commissioner Joaquín Almunia.
