It follows that, in view of the level of higher education required by the vacancy notice in the case of candidates who are staff from the national diplomatic services of the Member States, namely that provided for in Article 5(3)(b)(i) of the Staff Regulations for appointment to grades 5 and 6 in function group AD, and the number of years’ minimum professional experience required, which was only two, candidates who were staff from the national diplomatic services of the Member States, which included the applicant, could not be misled with regard to the grade that corresponded to the vacant post.

In a procedure for selecting candidates for a training programme designed to allow officials in the AST function group potentially to be appointed to a post in the AD function group by means of the certification procedure laid down in Article 45a of the Staff Regulations, the right to be heard guarantees that every candidate whose name is not included in the draft list of the highest ranked candidates pre-selected to participate in that training programme has the opportunity to make his views known on his exclusion, which is not yet definitive, usefully and effectively to the competent administrative authorities.

In the light of the case-law cited in paragraphs 43 to 45 above, the Tribunal considers that, in view of the obligations incumbent on a selection board, the decision not to include a candidate on a reserve list must be annulled if it transpires that the competition was organised in a way which led to a risk of inequality that was greater than that inherent in any competition, without the candidate concerned’s being required to provide evidence of the fact that some candidates were actually at an advantage.

Moreover, in the Commission’s view, obtaining information about the case study from other candidates might even be a disadvantage, since that test was designed to neutralise any prior knowledge a candidate might have of the subject of the test.

For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).
Aux fins du présent pourvoi, en premier lieu, il convient de relever que le Tribunal de la fonction publique a rappelé que toute décision individuelle prise en application du statut et faisant grief doit être motivée, et que l’obligation de motivation a pour objet, d’une part, de permettre au juge d’exercer son contrôle sur la légalité de la décision et, d’autre part, de fournir à l’intéressé les indications nécessaires pour savoir si la décision est ou non fondée et lui permettre d’apprécier l’opportunité de l’introduction d’un recours. Il a néanmoins ajouté, en faisant référence à l’arrêt de la Cour du 4 juillet 1996, Parlement/Innamorati (C‑254/95 P, Rec. p. I‑3423, points 24 à 28), que, en ce qui concerne les décisions prises par un jury de concours, l’obligation de motivation doit être conciliée avec le respect du secret qui entoure les travaux du jury en vertu de l’article 6 de l’annexe III du statut, secret institué en vue de garantir l’indépendance des jurys de concours et l’objectivité de leurs travaux. Ainsi, le respect de ce secret s’oppose à la divulgation tant des attitudes prises par les membres individuels des jurys que de tous éléments ayant trait à des appréciations de caractère personnel ou comparatif concernant les candidats, et l’exigence de motivation des décisions d’un jury de concours doit tenir compte de la nature des travaux en cause, lesquels, au stade de l’examen des aptitudes des candidats, sont avant tout de nature comparative et, de ce fait, couverts par le secret inhérent à ces travaux (points 30 et 31 de l’arrêt attaqué).

(e) in view of the nature of the work to be done, the age of candidates will also be taken into account: for example, it seems reasonable to stipulate that Members should not be over 65 at the end of their first term of office or over 70 at the end of their second. It would not be normal either if, through his or her appointment to the Court of Auditors, candidates were able to evade the age-limits applicable to the same post in their country of origin;

Under the American system of advice and consent, the US Senate does not attempt a critical evaluation of the candidate but simply votes to accept or reject the nomination (The Senate, which has to act within a strict timetable, can also reconsider its decision within a couple of days, on a proposal from a Senator who voted with the majority.) The vote takes place in public unless the Senate decides otherwise (Even in the exceptional circumstances of a closed vote, any Senator can choose to publicise his or her vote.) Attractively simple as the US system is, if the EU Constitution continues to insist on collegial rather than individual approval of the Commission the European Parliament is obliged to continue to try to advise on each candidate in order to inform its final, collective consent. But this does not necessarily mean that the Parliament cannot follow the approach of the Senate in setting out its views on individual members of the college by a vote rather than by a statement.

In saying this, we should also like once again to make clear that in view of what we said last year, namely that the first candidate countries can take part in the 2004 European elections, the accession treaties with those countries that are ready must be concluded by the end of 2002 given that the ratification process will then still have to be completed.
