In the event of such senior units being used as collateral, the special public supervision to protect bond holders as provided for in Article 52(4) of Directive 2009/65/EC of the European Parliament and of the Council of 13 July 2009 on the coordination of laws, regulations and administrative provisions relating to undertakings for collective investment in transferable securities (UCITS) shall ensure that the assets underlying such units shall, at any time while they are included in the cover pool be at least 90 % composed of residential mortgages that are combined with any prior liens up to the lesser of the principal amounts due under the units, the principal amounts of the liens, and 80 % of the value of the pledged properties, that the units qualify for the credit quality step 1 as set out in this Annex and that such units do not exceed 10 % of the nominal amount of the outstanding issue.

Nevertheless, this report, and thus the resolution contained in it, make a clear appeal for the communitarisation of the ESDP, as in Paragraph 9 of the resolution. I do not agree with that, and I consider that the criticism of the foreign policy of the United States is inappropriate. This criticism does not contribute to the climate of confidence needed to resolve these questions openly, nor to reinforcing the indisputable common heritage that unites and should continue to unite Europe and the United States.

With regard to other considerations that have been expressed here on the United States’ lamentable tendency to act unilaterally in many areas, not only in these matters of trade policy but also in other matters of general policy, the Presidency can only agree with many of the positions expressed here. I therefore believe that the forthcoming EU-US Summit to be held in Washington on 2 May will be a good opportunity for the Presidency of the Council and the Presidency of the Commission to remind the United States’ President that the spirit of the Transatlantic Declaration, which, as has been mentioned, was signed in 1995, binds the parties to maintain a spirit of cooperation, to seek common ground and not to seek ground that separates us and, in the fine tradition of the intense relationship between the United States and Europe, it is in the interests of both parties, the United States and Europe, to seek points of agreement and not of disagreement.
