The aid paid to LTS via Lintra Beteiligungsholding was the subject of the Commission's decision on aid to Lintra Beteiligungsholding GmbH(3) (Lintra decision).

(24) As regards any additional claims against the former LTS that should be taken into account in this proceeding, Germany would refer to its opinion in case C 41/99 concerning Lintra Beteiligungsholding. The opinion relates to Lintra's claims against LTS(12), amounting to a total of EUR 4088648,54.

(22) The Commission also pointed out that additional claims against the former LTS might arise out of the final decision in the still-pending case concerning Lintra Beteiligungsholding (C 41/99); these would have to be added to the costs of the present restructuring plan.

The aid paid to Gothaer Fahrzeugwerk in liquidation via the Lintra-Holding was evaluated in the case C 41/99 LINTRA, in which the Commission took a decision on 28 March 2001 (see IP/01/454) According to this decision DEM 35 million has to be recovered from the Lintra-Holding and its subsidiaries, including Gothaer Fahrzeugwerk in liquidation.

In March 1996 the Commission allowed aid to be given to the Lintra holding company and its eight subsidiaries. A plan to privatise the group subsequently collapsed. The Commission now concludes that DEM 623 million in aid was nevertheless granted in accordance with the restructuring plan for the group and complied with the Commission decision authorising assistance.
