Furthermore, following the entry into force of the amended Frontex Regulation at the end of 2011, the Commission encouraged Frontex and Europol to finalise the necessary arrangements for allowing the transfer from Frontex to Europol of personal data related to cross-border criminal activities facilitating irregular migration or human trafficking.

It responds to the Commission’s obligation to submit a report to the European Parliament and the Council on the implementation of the Return Directive, the main piece of EU acquis on return[2] (see the detailed part IV of this Communication), as well as to the political commitment made by the Commission when the amended FRONTEX Regulation was adopted in 2011 to report on the monitoring of return operations coordinated by FRONTEX (see section II.4.2).

In its proposal for a Regulation establishing rules for the surveillance of the external sea borders in the context of operational cooperation coordinated by Frontex[21], adopted in April 2013, the Commission ensured that any measures taken during surveillance operations coordinated by Frontex must be in full respect of fundamental rights and the principle of non-refoulement, which entails that no refugee should be returned to any country where he or she is likely to face the death penalty, torture or other inhuman or degrading treatment or punishment (Article 19(2)).

Despite the improvements introduced by the 2011 amendment, following the clear political guidance provided by the European Council in the course of 2015 on the role of the Frontex Agency in addressing the increasing migratory pressures and the external evaluation of the Frontex Agency in 2014/2015, the further revamping of the Agency's mandate is needed.
Malgré les améliorations apportées par la modification de 2011, à la suite des orientations politiques claires données par le Conseil européen au cours de l'année 2015 quant au rôle de l'agence Frontex pour faire face aux pressions migratoires croissantes et de l'évaluation externe de l'agence Frontex en 2014/2015, une nouvelle refonte du mandat de l'agence s'avère nécessaire.

The Commission shall consult the Frontex Agency on draft national programmes, in particular on the activities financed under the operating support, submitted by the Member States in order to develop complementarity between the mission of the Frontex Agency and the responsibilities of the Member States for the control and surveillance of external borders as well as to ensure consistency and to avoid cost inefficiency.

La Commission consulte Frontex au sujet des projets de programmes nationaux, en particulier au sujet des activités financées au titre du soutien opérationnel, présentés par les États membres afin de développer la complémentarité entre la mission Frontex et les responsabilités des États membres en matière de contrôle et de surveillance des frontières extérieures et de garantir la cohérence et d’éviter une mauvaise maîtrise des coûts.

Taking account of the new legal framework, envisaged by the proposal, in which FRONTEX is to operate in the near future, and which might also result in new operational tasks to be given to FRONTEX on the basis of the proposed Regulation, it is striking that the proposal is silent about the processing of personal data by FRONTEX, with a sole exception of the last sentence of Article 11.
Compte tenu du nouveau cadre juridique envisagé par la proposition, dans lequel FRONTEX sera opérationnelle dans les années à venir, et qui pourrait également se traduire par l’attribution de nouvelles tâches à FRONTEX sur la base de la proposition de règlement, il est frappant que la proposition n’évoque pas le traitement de données à caractère personnel par FRONTEX, à la seule exception de la dernière phrase de l’article 11.

This new legal framework, envisaged by the proposal, in which FRONTEX is to operate in the near future, and which might also result in new operational tasks to be given to FRONTEX on the basis of the proposed Regulation, has been carefully taken into account by the EDPS while reflecting on the content and the conclusions of this opinion.
Lorsqu’il a mené sa réflexion sur le contenu et les conclusions du présent avis, le CEPD a tenu compte de ce nouveau cadre juridique envisagé par la proposition, dans lequel FRONTEX sera opérationnelle dans les années à venir, et qui pourrait également se traduire par l’attribution de nouvelles tâches opérationnelles à FRONTEX sur la base de la proposition de règlement.
