Au regard également de la question 6, faut-il interpréter le règlement (UE) no 904/2010 du Conseil concernant la coopération administrative et la lutte contre la fraude dans le domaine de la taxe sur la valeur ajoutée (2) — au regard notamment de son septième considérant, selon lequel, afin de collecter la taxe due, les États membres devraient coopérer afin de contribuer à l’assurance de l’établissement correct de la TVA et, par conséquent, doivent non seulement contrôler l’application correcte de la taxe due sur leur propre territoire mais devraient également aider les autres États membres à veiller à l’application correcte de la taxe relative à une activité exercée sur leur propre territoire mais due dans un autre État membre —, en ce sens que, en présence de faits tels qu’en l’espèce, l’administration fiscale qui découvre l’existence d’une dette fiscale a l’obligation d’adresser sa demande à l’administration fiscale de l’État membre dans lequel l’assujetti faisant l’objet du contrôle fiscal a déjà satisfait à son obligation de s’acquitter de l’impôt?

Any corrections to the VAT-based own resource base under Article 9(1) of Regulation (EEC, Euratom) No 1553/89 shall give rise, for each Member State concerned whose base, allowing for those corrections, does not exceed the percentages determined by Articles 2(1)(b) and 10(2) of Decision 2014/335/EU, Euratom, to the following adjustments to the balance established pursuant to paragraph 1 of this Article:

The VAT-based own resource and the GNI-based own resource, taking into account the effect on these resources of the correction granted to the United Kingdom for budgetary imbalances and the gross reduction granted to Denmark, the Netherlands, Austria and Sweden, shall, however, be recorded in the accounts as specified in the first subparagraph as follows:

To that end, it lays down rules and procedures to enable the competent authorities of the Member States to cooperate and to exchange with each other any information that may help to effect a correct assessment of VAT, monitor the correct application of VAT, particularly on intra-Community transactions, and combat VAT fraud.
À cette fin, il définit des règles et des procédures permettant aux autorités compétentes des États membres de coopérer et d’échanger entre elles toutes les informations susceptibles de permettre l’établissement correct de la TVA, de contrôler l’application correcte de la TVA, notamment sur les opérations intracommunautaires, et de lutter contre la fraude à la TVA.
