At present, someone seeking to obtain Europe-wide protection for their invention has to validate European patents in all 28 EU Member States.

A European Patent validated for example in 13 countries costs as much as € 20 000, of which nearly € 14 000 arises from translations alone. This makes a European Patent more than 10 times more expensive than an American patent which costs about € 1850.

Disputes on national patents or on European Patents granted by the European Patent Office with effect for individual Member States are decided by the courts of the respective Member States. This means that bringing an action for infringement of a patent or contesting the validity of a patent may require bringing actions in a number of Member States, with all the difficulties and expense that entails. It is also possible that courts in different Member States may interpret patent law differently and reach incompatible verdicts.

Similarly where someone wants to challenge the validity of a European Patent he may need to bring actions in all the Member States where that European Patent is valid.
