7. An investment firm, before entering into securities financing transactions in relation to financial instruments held by it on behalf of a client, or before otherwise using such financial instruments for its own account or the account of another client shall in good time before the use of those instruments provide the client, in a durable medium, with clear, full and accurate information on the obligations and responsibilities of the investment firm with respect to the use of those financial instruments, including the terms for their restitution, and on the risks involved.
7. Unless the Commission has adopted an equivalence decision as referred to in Article 20(2) or (2a), supervised entities in the Union shall only use a benchmark provided by an administrator located in a third country, where it is used as a reference in existing financial instruments and financial contracts at the time of entry into force of this Regulation or where it is used in new financial instruments and financial contracts for three years from the date of application of this Regulation.
4. Member States shall adopt the necessary measures to ensure that resources paid back to financial instruments, including capital repayments and gains and other earnings or yields generated during a period of at least eight years after the end of the eligibility period, which are attributable to the support from the ESI Funds to financial instruments pursuant to Article 37, are re-used in accordance with the aims of the programme or programmes ◄ , either within the same financial instrument or, following the exit of those resources from the financial instrument, in other financial instruments provided that, in both cases, an assessment of market conditions demonstrates a continuing need for such investment, or in other forms of support.

The Commission should aim to create budgetary synergies between national, Union, multilateral and international measures and existing instruments by avoiding any potential overlap, and must therefore seek the most efficient use of available resources without compromising the just and fair use of the Union's resources, in particular by using financial instruments that have a leverage effect, allowing funds invested and generated by the financial instruments to be used and re-used in accordance with the relevant provisions of the financial rules.
