In case any such institution uses the resolution financing arrangement for any of such purposes, the resolution authority should be able to compare the risk profile of all other institutions covered by Article 45(3) of Directive 2014/59/EU with that of the institution which used the resolution financing arrangement and apply the methodology set out this Delegated Act to those institutions which present a risk profile similar or higher than that of the institutions which used the resolution financing arrangement.

whereas Article 45(2) of the SRM Regulation provides that the Board should submit an annual report to, inter alia, Parliament, on the performance of the tasks conferred on the Board by that Regulation; whereas that report should in particular cover Board activities as regards resolution planning, assessments of resolvability, determinations of minimum requirements for own funds and eligible liabilities, resolution actions, and the exercise of other duties and powers under the SRM Regulation; whereas that report should also cover detailed information regarding the Single Resolution Fund (the Fund), in particular the evolution of the available financial means of the Fund and any decisions concerning the period for reaching the target level and the calculation of contributions in accordance with Articles 69 to 71 of the SRM Regulation; borrowing, lending and other financial arrangements in accordance with Articles 72 to 74 of the SRM Regulation; the administration and investment strategy of the Fund, in accordance with Article 75 of the SRM Regulation and the applicable Commission delegated acts; the specific conditions of use of the Fund for an individual resolution scheme in accordance with Articles 76 to 78 of the SRM Regulation; the application of the principles of division into national compartments and of progressive merger during the transitional period provided for in Article 3(1)(37) of the SRM Regulation, in accordance with Article 77 of the SRM Regulation, and the use of deposit guarantee schemes in accordance with Article 79 of the SRM Regulation;

In fact, to the extent that the use of the Single Bank Resolution Fund by the SRM does not constitute State aid pursuant to the specific criteria laid down by the Treaty those criteria would still remain applicable, by way of analogy, to ensure that where the Resolution Fund is used, the same rules apply to its intervention as if the national resolution authorities were to use national financing arrangements.
En fait, dans la mesure où le recours au fonds de résolution bancaire unique par le MRU ne constitue pas une aide d'État au regard des critères spécifiques définis par le traité, ces critères devraient néanmoins rester applicables, par analogie, pour faire en sorte que, lorsqu'il est fait appel au fonds de résolution, les mêmes règles s'appliquent à son intervention que si les autorités nationales de résolution avaient recouru à des dispositifs de financement nationaux.

3. The Fund shall not be used directly to absorb the losses of an institution or an entity referred to in Article 2 or to recapitalise an institution or an entity referred to in Article In the event that the use of the resolution financing arrangement for the purposes in paragraph 1 indirectly results in part of the losses of an institution or an entity referred to in Article 2 being passed on to the Fund, the principles governing the use of the resolution financing arrangement set out in Article 24 shall apply.

In the event that the use of the resolution financing arrangement for the purposes in paragraph 1 of this Article indirectly results in part of the losses of an institution or an entity referred to in point (b), (c) or (d) of Article 1(1) being passed on to the resolution financing arrangement, the principles governing the use of the resolution financing arrangement set out in Article 44 shall apply.

Urges the Council to update the guidelines on the death penalty, in order to support all activities aimed at full implementation of the General Assembly resolution, which inter alia calls upon all States that still maintain the death penalty to respect international standards that provide safeguards guaranteeing the protection of the rights of those facing the death penalty, in particular the minimum standards set out in the annex to Economic and Social Council Resolution 1984/50 of 25 May 1984; points out that the resolution provides the Secretary-General with information relating to the use of capital punishment and observance of the safeguards guaranteeing protection of the rights of those facing the death penalty and seeks to progressively restrict the use of the death penalty and reduce the number of offences for which it may be imposed; further points out that the resolution ends by calling on all United Nations Member States to establish a moratorium on executions with a view to abolishing the death penalty;
prie instamment le Conseil d'actualiser les lignes directrices relatives à la peine capitale pour que soient soutenues toutes les initiatives visant une application intégrale de la résolution de l'Assemblée générale, qui, entre autres aspects, appelle tous les États qui maintiennent la peine de mort à respecter les normes internationales prévoyant des garanties pour la protection des droits des personnes passibles de la peine de mort, en particulier les normes minimales énoncées dans l'annexe de la résolution 1984/50 adoptée par le Conseil économique et social le 25 mai 1984; souligne que, aux termes de la résolution, des renseignements doivent être donnés au Secrétaire général sur l'application de la peine capitale et le respect des garanties pour la protection des droits des personnes passibles de la peine de mort et que les États concernés doivent s'employer à limiter progressivement le recours à la peine de mort et le nombre d'infractions qui valent cette peine; souligne également que la résolution appelle tous les États membres des Nations unies à instituer un moratoire sur les exécutions dans la perspective de l'abolition définitive de la peine de mort;
