TRADUCTIONS EN CONTEXTE

This Report responds to the requirement of Article 23(2) of the Directive 2011/36/EU on preventing and combating trafficking in human beings and protecting its victims, and replacing Council Framework Decision 2002/629/JHA, according to which: "The Commission shall, by 6 April 2016, submit a report to the European Parliament and the Council, assessing the impact of existing national law, establishing as a criminal offence the use of services which are the objects of exploitation of trafficking in human beings, on the prevention of trafficking in human beings, accompanied, if necessary, by adequate proposals".
Le présent rapport répond à l’exigence de l’article 23, paragraphe 2, de la directive 2011/36/UE sur la prévention de la traite des êtres humains et la lutte contre ce phénomène ainsi que la protection des victimes et remplaçant la décision-cadre 2002/629/JAI du Conseil, qui dispose: «La Commission présente au Parlement européen et au Conseil, au plus tard le 6 avril 2016, un rapport évaluant l’incidence sur la prévention de la traite des êtres humains des législations nationales en vigueur qui érigent en infraction pénale le fait de recourir aux services faisant l’objet de l’exploitation liée à la traite des êtres humains; ce rapport est accompagné, le cas échéant, de propositions appropriées».

The lack of criminalisation of the use of services of a trafficked person, especially with the knowledge that she or he is a victim of human trafficking, renders the overall fight against trafficking in human beings less effective and hinders the attainment of the objectives of Directive 2011/36/EU.

As stated in the Commission Staff Working Document accompanying the document Report on the progress made in the fight against trafficking in human beings and protecting its victims: “The final objective of eradication of trafficking in human beings can only be achieved ifthe crime is prevented from happening in the first place and using the wide range of available tools at EU and national level [.] This means not only addressing the root causes that make people more vulnerable to trafficking – such as poverty, gender inequality and violence against women, ethnic discrimination, societal marginalisation, irregular migration – but also ensuring that those who profit from the crime and exploit the victims are brought to justice”.

While maintaining and updating the core policy areas and cross-cutting themes of the overall EU Drugs Strategy, the new Action Plan identifies new priority areas for action, including the monitoring of new psychoactive substances as well as the use of new communication technologies for prevention of drug abuse and evidence gathering on the potential connection between drug trafficking and financing of terrorist groups, organised crime, migrant smuggling or trafficking in human beings.
S'il conserve et actualise les principaux champs d'intervention et les thèmes transversaux de la stratégie antidrogue globale de l'Union, il cible aussi d'autres domaines d'action prioritaire, notamment le contrôle des nouvelles substances psychoactives et l'utilisation des nouvelles technologies de communication pour la prévention de la toxicomanie et la collecte d'éléments de preuve sur les liens possibles entre le trafic de drogues et le financement des groupes terroristes, le crime organisé, le trafic de migrants ou la traite d'êtres humains.

All of them will be subject to five year maximum sentences, including the following: to obtain or possess identity information with intent to use it to commit certain crimes; trafficking in identity information with knowledge of or recklessness as to its intended use in the commission of a certain crime; and unlawfully possessing and trafficking in government-issued identity documents.

This bill would create three new offences, all subject to five year maximum sentences: obtaining and possessing identity information with the intent to use it to commit certain crimes; trafficking in identity information with the knowledge of, or recklessness as to its intended use in the commission of a certain crime; and unlawfully possessing and trafficking in government issued identity documents.

Those 19 offences are: using a firearm during the commission of an offence; using an imitation firearm during an offence; criminal negligence causing death by a firearm; manslaughter by use of a firearm; attempted murder by use of a firearm; causing bodily harm with intent with a firearm; sexual assault with a firearm; aggravated sexual assault with a firearm; kidnapping by firearm; hostage taking by firearm; robbery with a firearm; extortion with a firearm; possession of firearm knowing it is unauthorized; possession of a weapon device or ammunition knowing its possession is unauthorized; possession of prohibited or restricted firearm with ammunition; possession of a weapon obtained by commission of an offence; weapons trafficking; possession for purpose of weapons trafficking; making weapon into automatic firearm; importing or exporting firearm or prohibited weapon, or restricted weapon or prohibited device, or prohibited ammunition.

Section 5(3) of the Controlled Drugs and Substances Act is to be amended to provide for a minimum term of one year imprisonment for trafficking in heroin, cocaine, or cannabis, provided that the convicted person commits the offence as part of a criminal organization, as defined by section 467(1) of the Criminal Code; uses violence in committing the offence; is carrying or threatening to use a weapon in committing the offence; or has served a term of imprisonment for a designated substance offence — typically trafficking or importing in illegal drugs.
