The Deputy Prosecutor at the Supreme Court of the Hellenic Republic has requested the waiver of the parliamentary immunity of a Member of the European Parliament, Spyros Danellis, with regard to possible legal action concerning an alleged offence of falsely accusing a third party of an unlawful act with the intent of having him prosecuted for it, and of making false statements about a third party which could damage their reputation and good name, knowing such statements to be untrue.

There may be situations that would justify interceptions under s. 184.4 for unlawful acts not enumerated in s. 183. The Supreme Court dismissed the appeal. Section 184. 4 permits a peace officer to intercept certain private communications without prior judicial authorization if the officer believes, on reasonable grounds, that the interception is immediately necessary to prevent an unlawful act that would cause serious harm, provided judicial authorization could not be obtained with reasonable diligence.
L’article 184.4 permet à un agent de la paix d’intercepter certaines communications privées sans autorisation judiciaire préalable, s’il a des motifs raisonnables de croire qu’une interception immédiate est nécessaire pour empêcher un acte illicite qui causerait des dommages sérieux, pourvu qu’une autorisation judiciaire ne puisse être obtenue avec toute la diligence raisonnable.

In other words, section 184.4 of the Criminal Code allows a peace officer to intercept certain private communications without prior judicial authorization if the officer believes on reasonable grounds that the interception is immediately necessary to prevent an unlawful act that would cause serious harm, and provided that judicial authorization could not be obtained with reasonable diligence.

Currently, a peace officer can, pursuant to section 184.4 of the Code, intercept private communications without judicial authorization if the following conditions are met: (i) there are reasonable grounds to believe that the urgency of the situation is such that an authorization could not be obtained; (ii) an immediate interception is necessary to prevent an unlawful act that would cause serious harm to a person or to property; (iii) one of the parties to the communication is the originator or victim or intended victim of the unlawful act.

The term "unlawful acts" could constrain Member States' ability to decide what is unlawful and an offence.
