2. With regard to the Community actions financed under this Decision, the notion of irregularity referred to in Article 1(2) of Regulation (EC, Euratom) No 2988/95 shall mean any infringement of a provision of Community law or any infringement of a contractual obligation resulting from an act or omission by an economic operator which has, or would have, the effect of prejudicing the general budget of the European Union or budgets managed by the Communities, by an unjustified item of expenditure.

En ce qui concerne les actions communautaires financées au titre de la présente décision, l'irrégularité visée à l'article 1er, paragraphe 2, du règlement (CE, Euratom) no 2988/95 s'entend de toute violation d'une disposition du droit communautaire ou toute inexécution d'une obligation contractuelle résultant d'un acte ou d'une omission d'un opérateur économique qui a ou aurait pour effet de porter préjudice, par une dépense indue, au budget général de l'Union européenne ou à des budgets gérés par les Communautés.

For the Community actions financed under this Decision, Regulation (EC, Euratom) No 2988/95 and Regulation (Euratom, EC) No 2185/96 shall apply to any infringement of a provision of Community law, including infringements of a contractual obligation stipulated on the basis of the programme, resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the European Union or budgets managed by it, by an unjustified item of expenditure.

For the Community actions referred to in this Decision, the term ‘irregularity’ referred to in Article 1(2) of Council Regulation (EC, Euratom) No 2988/95 of 18 December 1995 on the protection of the European Communities financial interests shall mean any infringement of a provision of Community law or any non-performance of a contractual obligation resulting from an act or omission by a party, which has, or would have, because of an unjustified item of expenditure, the effect of prejudicing the general budget of the European Union or budgets managed by the Communities.
