However, in exceptional cases, the decision of the Court of First Instance can be reviewed by the Court of Justice at the request of the First Advocate General according to Article 225(2) of the EC Treaty, Article 62 of the Statute of the Court of Justice where there is a serious risk of the unity or consistency of Community law being affected.

All the patent decisions of the Court of First Instance would need to be evaluated as to their unity and consistency with Community law.

The proposed European Preliminary Chamber within the European Court of Justice would enable the necessary judicial safeguards to be provided, since it would be able to review the preliminary stage, ensure unity in the application and interpretation of Community law and fairness in the selection of the court in which the trial is to be held, and, naturally, uphold human rights in the course of the entire procedure.
