The United Kingdom is taking part in this [INSTRUMENT], in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis*.

Furthermore, insofar as its provisions relate to the provisions of Eurodac, by letter of 23 September 2009 to the President of the Council, the United Kingdom has notified its wish to take part in the adoption and application of this Regulation, in accordance with Article 3 of the Protocol on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice annexed to the TEU and the TFEU. The United Kingdom therefore takes part in the adoption of this Regulation, is bound by it and subject to its application.

26. Welcomes furthermore the decision taken by the United Kingdom and Sweden to take steps with a view to introducing national declarations on the management of Community funding, with in case of the United Kingdom provision being made for the declaration to be signed by a senior official with due authority in the relevant area; points out further that the Danish national audit body is to give an audit opinion on the management of community funding under shared management;

To the extent that it applies to third-country nationals who do not fulfil or who no longer fulfil the conditions of entry in accordance with the Schengen Borders Code, this Directive constitutes a development of provisions of the Schengen acquis in which the United Kingdom does not take part, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis ; moreover, in accordance with Articles 1 and 2 of the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, and without prejudice to Article 4 of the said Protocol, the United Kingdom is not taking part in the adoption of this Directive and is therefore not bound by it in its entirety or subject to its application.

The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and to the Treaty establishing the European Community and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis , to the extent that its measures develop provisions of the Schengen acquis against the organisation of illegal immigration in which the United Kingdom participates, and the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, having notified under Article 3 thereof its wish to take part in the adoption and application of this Decision.

Whereas the Council thus recognises the right of the United Kingdom to make, in accordance with Article 4 of the Schengen Protocol, a request for partial participation, noting at the same time that it is necessary to consider the impact of such participation of the United Kingdom in the provisions concerning the establishment and operation of the SIS on the interpretation of the other relevant provisions of the Schengen acquis and on its financial implications.
considérant que le Conseil reconnaît par conséquent le droit du Royaume-Uni, conformément à l'article 4 du protocole Schengen, de présenter une demande de participation partielle, mais fait également observer qu'il importe de tenir compte de l'incidence d'une telle participation du Royaume-Uni aux dispositions concernant la mise en place et le fonctionnement du SIS pour l'interprétation des autres dispositions pertinentes de l'acquis de Schengen ainsi que pour le volet financier.
